HC clarifies limitation period for land acquisition objections

Chennai: Madras high court has made it clear that, as per the provisions of the Tamil Nadu Highways Act, 2021, the 60-day limitation period prescribed for filing an objection by the landowner, whose property is acquired, should be calculated from the date on which they received the communication of the award fixed by the authorities and not from the date the decision was made.
“On the date of passing of the award, only the authority concerned will have knowledge of that award, whereas the aggrieved person will come to know about the decision only if it is communicated to them. Until such communication, the person will remain unaware of the decision and thus, they will not be able to file any objection/representation,” Justice Krishnan Ramaswamy said.
The court passed the order on a plea moved by S Jeyanthi, seeking to direct the special district revenue officer (land acquisition), Chennai-Kanyakumari Industrial Corridor Project, Chengalpet, to consider and dispose of her representation seeking higher compensation for acquisition of her 116 sqft land in Tambaram.

The authorities rejected her representation on the grounds that it was not filed within 60 days from date of the award. Refusing to concur, the court set aside the rejection order and made the clarification.
