COMMON ORDER
Pursuant to the earlier order passed on 12.09.2025, the
matter was listed for hearing today. At paragraph 7(a) of the previous order, this Court directed the respondents to ensure that all the 467 complaints are taken on file and FIRs are registered and thereafter, transferred to the file of the Special Investigation Team (SIT).
2. A status report has been filed by the Director General of
Police. The relevant portions are extracted hereunder:-

It is respectfully submitted that a Memorandum in RC No.947243/Crime.2(1)/2025 dated 25.09.2025 has been sent to all the unit officer to take necessary action as per the Hon’ble Court’s directions on the 467 complaints received in their respective police stations, register FIRs and transfer the same to SIT. The Additional Director General of Police, Economic Offences Wing (Head of ST), Chennai has also been requested to coordinate with the concerned unit officers and to ensure that all 467 complaints after registration get transferred to SIT within the stipulated time.
4. It is respectfully submitted that on receipt of the order copy of this Hon’ble High Court dated 12.09.2025 on 08.10.2025, again a memorandum vide RC No.947243 / Crime 2(1) 2025 dated 08.10.2025 was issued to all
Superintendents of Police in Districts and Commissioners of Police in cities to register FIRs in all 467 complaints as directed by the Hon’ble Court and transfer the cases to SIT headed by the Additional Director General of Police, Economic Offence Wing, Chennai for further investigation. They were directed to send compliance report regarding the same to the office of the Director General of Police and Head of Police Force, Chennai.
5. It is respectfully submitted that in compliance with the directions issued by the Hon’ble High Court of Madras, the details of the action taken so far are tabulated below:

It is respectfully submitted that necessary action is being undertaken expeditiously to register FIRs based on the remaining complaints received at Police Stations and to transfer the same to the Special Investigation Team (SIR) headed by the Additional Director General of Police, Economic Offences Wing, Chennai for further investigation.
3. The learned Additional Public Prosecutor submitted that out of the 432 FIRs that have been registered, 159 FIRs have been
transmitted to the file of the SIT.
4. At paragraph 7 (b) of the earlier order, this Court directed the learned Principal Sub Judge, Hosur and the learned Additional District Judge, Hosur to submit a report. On verifying the records, it is seen that these reports are yet to be received. In view of the above, the Registry is directed to follow up with the concerned Courts and get the reports before the next date of hearing.

A memo has been filed on the side of the petitioner and as per this memo, apart from the 467 complaints which covers nearly a claim amount of Rs.105,23,56,770/-, there is another set of 308 complaints which pertains to a claim amount of nearly Rs.75,78,55,543/-. The particulars of the complaints have been annexed along with the memo as List I and List II. The learned counsel appearing on behalf of the
Cholamandalam MS General Insurance Company Ltd and The New India Assurance Company Limited requested this Court to attach as a annexure the particulars of the complaints that have been given so that it can be placed before the concerned Court where the case is pending. Yet another request was made to the effect that the respondent police can be directed to correlate the MCOP Numbers, claim made and also the Crime numbers assigned to the respective FIRs.

In the light of the above memo filed on the side of the petitioner, there shall be a direction to the respondents to act upon 308 complaints, which forms part of List II and the earlier directions issued at Paragraph No.7(a) for the 467 complaints shall equally apply to these 308 complaints also. Hence, the FIR shall be registered and it shall be transferred to the file of the SIT.
7. The respondents are directed to prepare a tabulated statement correlating each claim made to the respective crime number assigned in the FIRs. This will enable the insurance company to bring to the notice of the Court below which deals with the said claim.
7. The list I and List II that has been filed along with the memo on the side of the petitioner shall form part of this order.
8. Post this case for hearing on 23.02.2026. By then, the Registry shall follow up and get the reports from the Court below. A status report shall also be filed by the respondent with necessary particulars.
