    Madras High court order dated 28.10.2025 in CRP NO. 2434 OF 2001. The issue involved in the matter is, that A general power of attorney cannot be used for mortgaging the property in the bank in the absence of registration as per section 49 of the registration act . The deed of power of attorney not contained a special clause for third party guarantee to the borrower. Advocate R.LAKSHMI NARASIMHAN from Madras High Court appeared for petitioner.
