Their Lordships were pleased to dispose of the applications filed by the petitioners seeking appointment of an advocate commissioner to examine and submit reports about the crematoriums in the Perur Taluk and that neighbouring villages from site, to drive the point that there are sufficient number of crematoriums already in the vicinity and that the petitioner SN Subramanian’s house is at a distance of merely 14 feet and the tribal people are residing at a distance of 280 metres. Yet another petitioner had also raised the additional ground that the very act passed by Tamil Nadu government, namely the Tamil Nadu Village Panchayat Provision of Butiql and Burning Grounds Rules itself is ultra virus on the ground that as per the amendments to the Constitution and the 11th and 12th schedule, a village Panchayat is not empowered to decide issues regarding burial and cremation and does not have the powers.

When these applications came up for hearing today, the Honble First Bench was pleased to dispose of the same stating that the issue of appointing advocate commissioner can be decided based on the exigency at the time of final hearing and if it becomes necessary, they will consider it. Therefore, the matter is Adjourned to January 2026, after Pongal holidays.
