[1/22, 20:59] Advt JAGANNATHAN: The Shooting and Firing incident between Two Political Groups at Thiruporur off OMR triggered widespread massive public outrage over the shady land deals , Fraudulent Illegal Forgery Documentation including Double Documentation during July,2020 of Prime Valuable Temple lands and properties belonging to Arulmighu Thiruporur Kandasamy Murugan Temple and Arulmighu Alavandar Charitable Endowment trust both temples and properties belonging to the Hindu Religious Charitable Endowment Department coming under the control of Government of Tamilnadu.

Pursuant to an Article that appeared in the Times of India Newspaper wherein it was highlighted that online transactions of Temple properties in more than 92 Survey Numbers belonging to both the temples were Blocked measuring to more than 2000 Acres and worth more than 60,000 Crores roughly translating to USD 8 Billion – A Public Interest Litigation was filed by Advocate B. Jagannath before the Honble Madras High Court.

The Learned Division Bench of the Honble Madras High Court comprising of Mr. Justice MM Sunderesh and Mrs Justice Hemalatha upon hearing the matter on Admission on 04.09.2020 had accepted the plea of Mr. Jagannath and his arguments and Granted an Interim Order of STATUS QUO restraining the Respondents more specifically the Sub Registrar of Thiruporur NOT to Register the temple Properties as aforementioned with a view to protect and safeguard the temple properties and lands and Ordered Notice and further Suo Motto Impleaded the District Collector of Chengalpet and Kanchipuram as Party Respondents to the case with a DIRECTION TO PERFORM PHYSICAL MEASUREMENTS OF ALL TEMPLE LANDS belonging to both the temples as aforementioned and SUBMIT a STATUS REPORT specifically indicating Encroachments.

During the subsequent hearings in October 2020 after hearing the detailed arguments for Counsel for both parties including the Government Pleader for the State Government the Learned Division Bench of the Honble Madras High Court comprising of Mr. Justice Satyanarayana and Mrs Hemalatha had Ordered The Status Quo to continue UNTIL FURTHER ORDERS.

In Compliance to the aforementioned DIRECTION – the District Collector of Chengalpet District had submitted a STATUS REPORT during SEPTEMBER,2020 with a. Specific Tabulation indicating as follows
[1/22, 21:09] Advt JAGANNATHAN: The total lands and properties Belonging to Arulmighu Thiruporur Kandasamy Temple was 244.44 Hectares corresponding to roughly more than 605.395 Acres in Chengalpet District wherein more than 188.91 Hectares corresponding to Approximately 467 Acres of Lands were under ENCROACHMENT according to the Government and the remaining lands was about 55.52 Hectares corresponding to roughly 137 Acres of land.

Furthermore, for Arulmighu Alavandar Charitable Endowment trust the total land in Chengalpet District is roughly 287.66 Hectares corresponding to roughly 710 Acres and the lands under Encroachment was 7.37 Hectares corresponding to roughly 19 Acres and the remaining extent of land was 279.91 corresponding to roughly 692 Acres.
[1/22, 21:24] Advt JAGANNATHAN: The said Status Report had further revealed that the Chengalpet Revenue Divisional Officer upon the request of the Executive Officer of the Arulmighu Alavandar Charitable Endowment trust and temple based on the Aforementioned Direction had

Rectified Discrepancies and Corrected Computer Patta and Reverted in temple Name vide Proceedings dated 24.06.2021 made in RC number 1493/2021/B3 for lands in Survey number 168/1A1A1C2B, 2A1 and C3B and that there is Joint Patta in the name of 52 individuals in Survey No 168/3E1A1AC2A measuring 35 Acres and that in approximately 265 Acres Patta in Survey 168/1A,1C,24-26 vested exclusively in the name of Arulmighu Alavandar Charitable Endowment trust with roughly 35 more Acres under Acquisition for Road Widening of OMR Project Under Land Acquisition.
[1/22, 21:37] Advt JAGANNATHAN: Pursuant to the said Status Report filed by the Government the Learned Division Bench comprising of Honble Acting Chief Justice and Mr. Justice PD Audikesavalu on December,2021 had Given a Direction to the Government whether the said Lands were covered under Section 22A of the Registration Act,1908 which was brought into force in 2016 vide Amendment in 2012 – which ensured that the Registrar/ Registering Authority would REFUSE TO REGISTER those properties – essentially valuing it as Zero Value Properties- pertaining to Endowment lands belonging to both the temples and also directed to initiate Eviction and Removal of Encroachment in accordance with law as per Section 78 of the Hindu Religious and Charitable Endowment Department Act and reply in the next hearing.
[1/22, 21:40] Advt JAGANNATHAN: The Learned Government Pleader on January 21,2022 submitted an Order dated 20.01.2022 wherein it was accepted by the Government through an Order that the Classification of properties and temple lands belonging to both the aforementioned temples would come under Section 22-A of the Registration Act,1908 and furthermore the Properties of both the Temples would not be Accepted for Registration and that Entire Section 78 Proceedings for both the temple roughly measuring about
550 ACRES would be completed within 2 months in accordance with law.
[1/22, 21:48] Advt JAGANNATHAN: The Learned Division Bench of the Honble Madras High Court comprising of the Acting Chief Justice and Mr Justice PD Audikesavalu on January 22,2021 in a Major Landmark Judgement involving Section 22A of the Registration Act pertaining to both the temple properties had recorded the Submission of the Government Pleader and Ordered the Registration Department to Treat the Temple properties as under Section 22A of the Act of 1908 which would ensure that they are Zero Value Properties and Refusal to Register the Properties of both the aforementioned temples and also Ordered Removal of Encroachment under Section 78 of the Hindu Religious and Charitable Endowment Act – A Compliance Status Report of the Same to be submitted before the Registry of the Honble Madras High Court 10.05.2022 and the entire process of Removal of All Encroachments belonging to both the temples to be completed by 30.04.2022 and Disposed the Main Case as the Relief Sought for by the Petitioner had been Successfully Granted.
[1/22, 22:51] Advt JAGANNATHAN: Its a Landmark Judgement as For the First Time High Court has granted an Order as per under Section 22A Amendment of the Registration Act,1908 for Hindu Religious and Charitable Endowment Department Temple properties- Amendment brought in 2012 and in force from 2016 for 2000 Acres of Temple properties belonging to both Arulmighu Kandasamy Temple at Thiruporur and Arulmighu Alavandar Charitable Endowment Trust and Consequently has ordered to remove all Encroachments of about 550 Acres belonging to both Temples within 100 days 🙏🏻
