01.02.2025 and Supplementary production agreement dated 28.03.2025.

This original application is filed seeking an order of interim injunction to restrain the respondents, their men, agents or anyone acting on their behalf from releasing, distributing, exhibiting or exploiting the Malayalam Feature Film titled NEEKKAM, (starring Dileep Kumar and directed by Jagan Shaji Kailas) in theatres, through OTT Platforms or other platforms or any other broadcasting or television channels, pending the protection of the applicant’s financial interests and resolution of disputes through arbitration, as provided under the production agreement dated 01.02.2025 and Supplementary production agreement dated 28.03.2025.
2. Heard Mr.J.Sivanandaraaj, Senior Advocate appearing for the
applicant.
3. Considering the fact that the first respondent, who is the proprietor of Urvasi Theatres under the supplementary agreement had given a priority charge on his next film on failure of making the good on the advance by the applicant and also taking note of the fact that the cheque issued pursuant to the agreement for the earlier film had also been bounced and that the film titled ‘Neekkam’ produced by the Urvasi Theatres of which the first respondent is the proprietor is to be released as evident from the advertisement issued by the first respondent, there shall be an order of injunction as prayed for.
4. Notice to the respondents returnable in four weeks. Private notice is also permitted.
