In continuation of an earlier order dated 09.12.2025,
Mr.B.Vijay has circulated the Additional Standard Operation Procedure; e–auction Draft Notification; draft copy of the press release both in English and in Tamil and status report.
2.Incidentally, on 10.10.2025, the Standard Operating
Procedure was circulated before us which reads as follows:-
STANDARD ORPERATION PROCEDURE
The properties of Kalaimagal Sabha are spread across the state of
Tamil Nadu and also in the states of Karnataka, Delhi and Puducherry. In Tamil Nadu, the properties are located across 33 districts. On the directions of the Hon’ble High Court of Madras in the W.A.No. 472 of 2024 dated 25.09.2025, to submit the Standard Operating Procedure (SOP) setting properties, the following proposal is submitted before the Hon’ble High Court of Madras. This S.O.P is of three phases.
A. Valuation of the properties
B. Categorization of the properties
C. Auction of the properties
A. Valuation of the Properties
1. In order to ascertain the value of the properties, a dedicated committee will be formed for each district where properties are located. The said committee will consistsof
i. District revenue officer
ii. Two Valuers
iii. District Registrar
2. This committee will be chaired by the District Revenue Officer (DRO) of the concerned district where the property is situated.
3. The two professional valuers shall have extensive experience and a reputable standing in the concerned district's real estate market. "Institution of Valuers" will be approached to provide a list of qualified individuals along with their years of experience, ensuring a larger pool of credible experts and the same shall be submitted before this Hon’ble Court. It is respectfully submitted that the two valuers may be nominated by the Hon’ble High Court of Madras.
4. The District Registrar (Administration) of the respective registration district will also be a member, bringing expertise in property registration and documentation.
5. This four-member Valuation committee will meticulously prepare the valuation report of the properties of the Society in its district. They have to make a thorough assessment of the current market value of the properties taking into factors like location, accessibility, development potential, and prevailing real estate trends in the particular area while arriving at Fair Market value of the properties.
6. The committee shall also seek remarks for the valuation of the properties from the concerned District Collector. Then the Committee shall forward the Valuation report in a sealed cover to this High Court.
7. The value arrived at by this committee may be perused by this Hon’ble Court and an upset price for the property may be fixed by this Hon’ble Court.
B. Categorisation of Properties
The properties of the Society will be systematically categorized and prioritized for auctioning based on complete and comprehensive field-level surveys already undertaken by the department. This structured approach is adopted to ensure a smoother and effective implementation of auction sale of the properties.
1) Category 1: Clear & Unencumbered Properties:
The Properties that are free from any physical encroachments, have a clear 'patta' in the name of the Society/Kalaimaghal Sabha, and are free from any legal encumbrances, such as mortgages, liens, or disputes are put under Category-I. These properties will be prioritized for auction due to their clear title and ease of transfer, ensuring quicker realization of funds.
2) Category 2: Clear title to the property, But Revenue records in different name(s)
The Properties without any physical encroachments or legal encumbrances, but where the patta and other revenue documents is currently in the name of another person(s) or entity, despite the fact that the property belonging to Kalaimaghal Sabha based on registered sale deeds. The auction of the properties will be put into auction immediately after the change of revenue records in the name of the Society. Based on the existing records and deeds in the name of the Society immediate and diligent steps will be initiated to rectify the 'patta' and other revenue records and have it correctly changed in favour of Kalaimaghal Sabha.
3) Category 3: Encumbered & Encroached Properties:
The properties that are affected by the encroachments or have existing legal encumbrances recorded against them will be categorised as Category-III. These properties will only be brought up for auction after all encumbrances have been settled or removed. Also any & all encroachments shall be removed in accordance with law. A clear action plan will be devised for each such property to resolve these issues before auctioning, ensuring that buyers receive a clear title.
C. Auction of Properties
1) To ensure maximum transparency, competitiveness, and adherence to best practices prevalent in state of Tamil Nadu for government/quasi-government property auctions, the following detailed procedure will be adopted:
2) Mode of Auction will be E-Auction: The properties will be brought under auction through a highly transparent eauction cum tender system. This digital format significantly reduces manual intervention, increases accessibility for bidders, and provides an auditable trail. The auction will preferably be conducted through a reputable
Government/Quasi-Government portal (e.g., portals used by the Tamil Nadu Housing Board, TANGEDCO, or similar state entities for their own property dispositions).
3) Wide and Extensive Publicity shall be given for auction Sale of the properties through comprehensive advertisements in leading English and Tamil daily newspapers with wide circulation in the area where the properties are situated. Further the same shall be published in the Websites designed/to be designed by the Special Officer specifically for the Sale of the Society. In addition to the same strategic advertisements will be placed on prominent national and regional real estate websites and portals targeting a broad spectrum of potential buyers.
4) To ensure professional conduct and adherence to established norms, the services of Government Bodies/Organisations with proven expertise in property auctions will be engaged. Physical notices will be displayed at the concerned District Collectorates, Sub-Registrar offices, Taluk offices, and at the property sites themselves, ensuring local awareness.
5) A detailed Information Memorandum (IM) for each property or cluster of properties will be prepared and made available online. This IM will include property details, location maps, photographs, valuation report summaries, terms and conditions of auction, eligibility criteria for bidders, and contact information for queries.
6) The Tamil Nadu Housing Board (TNHB), Tamil Nadu Cooperative Housing Society, or other government bodies and organisations or corporations known for their robust auction procedures and infrastructure will be considered. Their involvement will lend credibility and efficiency to the process. These bodies can assist in managing the e-auction platform, handling bidder registration, conducting site visits, addressing queries, and ensuring compliance with all legal and procedural requirements.
7) The Prospective bidders will be required to register online on the designated portal, providing necessary KYC (Know Your Customer) documents as per prevailing government norms to ensure genuine participation.
8) Earnest Money Deposit (EMD): A mandatory Earnest Money Deposit (EMD), as a percentage of the upset price that may be fixed by this Honble Court, will be collected from all registered bidders as pre condition for participating in the bidding process. The EMD will be refundable for unsuccessful bidders.
9) High Court Approval: The details of the successful auction consisting of all details like, bidder details, bidding history, payments made by the successful bidders will be meticulously placed before this Hon’ble Court for final confirmation and approval. After the grant of approval by this Honble Court, Sale Deed(s) will be executed in favour of the successful bidder after the receipt of entire amount and after payment of prevailing Stamp Duty and Registration Charges.
10) The successful bidders have no right to seek reduction of the final bid and they shall have no right to seek for concession or reduction or exemption of stamp duty and registration charges payable for execution of the Sale Deeds. All stamp duty and registration charges will be borne by the buyer as per Tamil Nadu Registration Act and Stamp Act rules.
This SOP emphasizes a multi-pronged approach to transparency, combining digital platforms, extensive outreach, expert oversight, and rigorous adherence to legal and administrative protocols in the state of Tamil Nadu, thereby maximizing the value realization for Kalaimagal Sabha's properties.
3.The Additional Standard Operation Procedure circulated to us today reads as follows:-
Additional Standard Operation Procedure
A. The Valuation Committee must prepare comprehensive valuation report of immovable property. The Valuation Committee shall forward the valuation report to the Special Officer for final scrutiny and verification. After scrutiny of valuation reports, the Special officer shall place scrutinised valuation report before the Hon’ble One Man Commission for approval.
B. The upset/reserve price shall be finalised only upon express approval of the Hon’ble One Man Commission.
C. Upon approval of the upset/reserve price, the Special Officer shall prepare the E-auction schedule, auction terms, draft E-auction notification and bidder registration requirements.
D. The draft E-auction notification shall be submitted to the Hon’ble One Man Commission for approval.
E. After approval, the notification shall be published in leading newspapers (Tamil and English) will be notified in the website of Kalaimagal Sabha and in (tntenders.gov.in)
F. Upon closure of the auction, the Special Officer shall prepare bid scrutiny report and place before the Hon’ble One Man Commission for consideration and approval.
G. After examining the bid scrutiny report and the validity of the highest bid, the Hon’ble One Man Commission may prepare a concise recommendation report.
H. The Hon’ble One Man Commission may forward the concise report to the Hon’ble Special Bench of Madras High Court for final consideration.
I. Upon confirmation of sale by the Hon’ble Special Bench, the Special Officer shall issue a formal demand to the successful bidder to remit the balance sale consideration within the time stipulated by the Hon’ble Court.
J. After receipt of entire sale consideration, the Special Officer shall prepare the Sale Certificate in accordance with law. The certificate shall be placed before the Hon’ble One Man Commission for authentication. The authenticated Sale Certificate shall be issued to the auction purchaser.
6.This Additional Standard Operating Procedure shall govern the valuation, auction, monitoring, confirmation, and postsale processes pertaining to the immovable properties of Kalaimagal Sabha, under the supervision of the Hon’ble One Man Commission and the Hon’ble Special Bench of this Hon’ble Court. All procedures shall be conducted with tranparency, fairness, and adherence to judicial directions.
4.After deliberations, we are inclined to accept the aforesaid standard operating procedure, as well as the additional standard operation procedure, as a guideline for the e–auction process to be undertaken.

Other conditions a. The intending bidder should abide by the rules of tntenders.gov.in vis-a-vis the auction in respect of KYC guidelines, Balance in their Wallet for covering the EMD Amount etc.
b. All intending bidders must mandatorily submit valid and complete Know Your Customer (KYC) documents as prescribed by the e-auction platform and the Special Officer. Failure to provide the required
KYC documents or submission of incomplete/ invalid KYC information shall render the bidder ineligible to participate in the auction.
c. Participation in e-auction will be allowed by tntenders.gov.in portal to those who comply with the terms of auction and fulfil the eligibility criteria therefor. Interested bidders may deposit Pre- Bid EMD to their Wallet with tntenders.gov.in before the last date& time as mentioned at SI. No.6 above, through Online transfer of funds using NEFT/Transfer, using challan generated on e-Auction Platform. Credit of Pre-Bid EMD shall be given to the bidder only after receipt of payment in tntenders.gov.in account and updation of such information on the e-Auction website. This may take some time as per administrative process and hence bidders are advised to deposit the PreBid EMD amount well in advance to avoid any last-minute problem.
d. The provisional successful bidder will be

communicated suitably, subject to further confirmation by Hon’ble One Man
Commission after validation of each of the eligibility criteria/KYC details/EMD amount deposit etc., and further confirmation by the Hon’ble Special Bench of Madras High Court.
e. The Special Officer shall not have any liability towards bidders for any interruption or delay in access to the site irrespective of the causes.
f. The bidders are required to submit acceptance of the terms & conditions and modalities of e-auction adopted by the service provider before participating in the e-auction.
g. The bid once submitted by the bidder, cannot be cancelled/withdrawn and the bidder shall be bound to buy the property at the final bid price. The failure on the part of bidder to comply with any of the terms and conditions of e-auction, mentioned herein will result in forfeiture of the amount paid by the defaulting bidder.
h. The bids submitted without the EMD shall be summarily rejected.
i. The properties shall not be sold below the reserve price.
j. The conditional bids may be treated as invalid. Please note that after submission of the bids, no correspondences regarding any change in the bid shall be entertained.
k. The EMD of the provisional successful bidder shall be retained towards part sale consideration and the EMD of the unsuccessful bidder will be refunded by tntenders.gov.in. The bidders will not be entitled to claim any interest, costs, expenses, and any other charges (if any).
l. In case the auction requires to be adjourned/postponed/cancelled for whatsoever reason, it will be subject to the prior approval of the Hon’ble One Man Commission report and further

ratification of the Hon’ble Special Bench of Madras High Court.
m. The highest bid, along with the Hon'ble One Man Commission’s report, will be placed before the Special Bench of the Madras High Court, for confirmation. Until such confirmation is expressly communicated in writing, no bidder shall have any claim, right, or interest in the property, irrespective of the amount of the bid offered.
n. In case of forfeiture of the amount deposited by the defaulting bidder, he shall neither have claim on the property nor on any part of the sum for which may it be subsequently sold.
o. The declared successful bidder shall bear all the necessary expenses like applicable stamp duties/additional stamp duty/transfer charges, Registration expenses, fees etc. for transfer of the property in his/her/their name.
p. The Special Officer will prepare the Sale Certificate in accordance with law. The certificate will be placed before the Hon’ble One Man Commission for authentication. The authenticated Sale Certificate will be issued to the auction purchaser.
q. The Sale Certificate will be issued after receipt of entire sale consideration and confirmation of sale. The Sale certificatewill be issued in the name of the declared successful bidder. In case, of any nomination made by the bidder in favour of the other person than the person who submitted the bid/participated in the auction, the same will be subject to the approval of the Hon'ble One Man Commission.
r. The Sale Certificate to be issued by the by the Special Officer shall attract 7% Stamp duty and 2% Registration fees. The Sale Certificate is compulsorily registerable. Any request for forwarding the sale certificate
U/s 89 of Registration Act would not be permitted.
s. The payment of all statutory /non- statutory dues, taxes, GST, rates, assessments, charges, fees etc., owing to anybody shall be the sole responsibility of declared successful bidder only and, such dues/charges/taxes shall be over and above the Bid Price.
t. The bidders are advised to in their own interest to satisfy themselves with the title and correctness of other details pertaining to the immoveable/secured assets including the size/area of the immovable/secured assets in question. They shall independently ascertain any other dues / liabilities / encumbrances in respect of the properties from the concerned authorities to their satisfaction before submitting the bids. It would not be open for the Bidder(s) whose bid is accepted by Special Officer to withdraw his bid, either on the ground of discrepancy in size/area, defect in title, encumbrances, or any other ground whatsoever.
u. In case any dispute arises as to the validity of the bid(s), amount of bid, EMD or as to the eligibility of the bidder, authority of the person representing the bidder, the interpretation and decision of the Special Bench of Hon’ble High Court shall be final. In such an eventuality, the Special Bench of Hon’ble High Court Hon’ble High Court shall in its sole discretion be entitled to call off the sale and put the property on sale once again on any date and at such time as may be decided by the Special Bench of Hon’ble High Court Hon’ble High Court.

7.The Special Officer is called upon to prepare the final notification of the e–auction for both properties in Coimbatore District and Tiruvarur District along with the schedule of properties, reserve price, etc., which shall be the price indicated by the Valuation Committee for the said properties, in line with the draft notification referred above.
8.The Special Officer shall also cause to publish the press release both in Tamil and English versions in two leading Newspapers, having wide circulation in the state of Tamil Nadu and Union Territory of Puducherry on 15.12.2025. It shall also be ensured that the published advertisement is conspicuously displayed in the Newspaper in a comfortable size.
