ORDER
Pursuant to the earlier order passed on 06.07.2026, compliance report has been filed by the Director General of Police and the relevant portions are extracted hereunder:
3.It is respectfully submitted that, in compliance
with the directions contained in paragraph 7 of the order, on the next day of the hearing itself, ie. on 07.07.2026, the soft copies of the necessary details in respect of List-I and List-II, were furnished to Mr.N.Vijayaraghavan, learned counsel for the Petitioner, through the Office of the Public Prosecutor, to enable him to pursue the matter with the respective Insurance Companies and obtain the necessary particulars, thereby facilitating registration of FIRs by the concerned jurisdictional Police. Hard copy of the same were also subsequently furnished to Mr.N.Vijayaraghavan, learned counsel for the petitioner through the Office of the Public Prosecutor vide communication bearing Rc.No.947243/Crime 2(1)/2025 dated 22.07.2026.
4.It is respectfully submitted that, in compliance with the directions contained in paragraph 8 of the order, communications in Rc.No.947243/Crime 2(1)/2025, dated 17.07.2026, have been addressed to the Offices of the Director
General of Police, Andhra Pradesh, Karnataka, Kerala and the Union Territory of Puducherry, requesting them to take necessary action for registration of FIRs in respect of complaints falling within their respective territorial jurisdictions.
2.When the earlier order was passed, this Court directed the Registry to send a copy of the order along with the previous orders dated 18.04.2022 and 12.09.2025 and to get a report from the concerned Courts.
3.Mr.Chandrasekaran, learned counsel appearing on behalf of the District
Legal Services Authority, Krishnagiri, produced the copy of the report from the
Principal Subordinate Judge, Hosur (FAC) and the Additional District Judge, Hosur. Insofar as the Principal Subordinate Judge, Hosur (FAC) is concerned, the report reads that there are no cases pending and whatever cases came under this category has already been closed. Insofar as the Additional District Judge, Hosur is concerned, out of 14 cases that were pending, 10 cases were disposed as dismissed for default and even the remaining 4 cases were either dismissed for default or dismissed as withdrawn. The learned Additional District Judge, Hosur has confirmed that the documents filed along with the claim petitions are all available in case records and no documents are missing. It is not known whether the documents pertains only to the 4 cases that has been mentioned in the status report or such original documents are available for all the cases (85 nos.) which falls under this category.
4.Even if the cases are closed or dismissed for default or dismissed as withdrawn, if the records filed along with the claim petitions are fake documents, it gives rise to a cause of action to prosecute the concerned persons. Hence, there shall be a direction to the learned Additional District Judge, Hosur and the Principal Subordinate Judge, Hosur (FAC) to clarify as to whether the documents that were filed along with 85 MCOP cases are available. If the original documents are not available in any of those cases, an explanation shall be given in that regard. For the sake of convenience, the report filed by the Principal Secretary, Tamil Nadu State Legal Services Authority dated 28.8.2025 is annexed along with this order and it contains the particulars of 85 MCOP cases.

5.Insofar as the clarification sought for at paragraphs 12 and 13 in the previous order passed by this Court, Mr.N.Vijayaraghavan, learned counsel submitted that he has already informed all the Motor Insurance Companies and he has received response only from eight of the identified Insurance Companies and the rest of the Insurance Companies have not responded till now. Mr.N.Vijayaraghan, learned counsel submitted that approximately 12 cases will fall under this category and as and when any appeal is filed, it can be dealt with by the Court.
6.Insofar as the pending cases are concerned, at paragraph 14 of the earlier order, this Court made it clear that the concerned Tribunal will independently go into the issue of the genuineness or otherwise of the policy based on the evidence placed before the Tribunal and render a finding.
7.Mr.N.Vijayaraghavan, learned counsel also brought to the notice of this
Court that initially 775 complaints were given for fake policies to the value of 181,02,12,313 crores and ultimately the present position is that there are 713 complaints which are effectively under investigation and the fake policies involved is to the tune of 166,27,46,606/-.
8.Insofar as the criminal case in Crime No.247 of 2024 which involves some advocates, the investigation has been completed and the police report has been filed before the Judicial Magistrate No.II, Hosur which has been taken on file in CC.No.279 of 2026 and the case is posted on 20.08.2026 for furnishing copies to the accused persons.
9.The Registry is directed to follow up with the Principal Subordinate Judge, Hosur (FAC) and the Additional District Judge, Hosur and get the report before the next date of hearing.
10.Post this case on 31.8.2026 at 2.15 p.m.
