[05/11, 21:21] Sekarreporter: On 04.11.2025, Hon’ble high cour of madras delivered a landmark judgement in W.P.No.8916 of 2025, W.P.No. 10456 of 2025, W.P.No.21164 of 2025 and W.P.No.21848 of 2024 – WRIT petitions filed by Directly recruited Deputy Superentindent of Police and Assistant Commissioner of Police (DSP’s/AC’s) of Tamilnadu cadre, seeking a direction to the Tamilnadu government to promote the Petitioners to the post of Additional Superentindent of Police/Additional Deputy Commissioner of Police (ASP/ADC) and also sought a direction to the state government to hereafter follow only the procedures laid down in Service rules, to fill up the vacancy of ASP/ADC through inter se seniority list drawn by the panel by duly following the ratio 2:1 as stated in the service rules. So that well qualified direct recruited officer in the rank of DSP’s/AC’s will also get promoted to their next rank. As on date, more than 10 years the state government was in the pratice of preparing temporary panel on adhoc basis, after giving various relaxation to the service rule and was filling the ASP/ADC vacancy only through Promoted officers, without considering directly recruited officers.

The above WRIT petitions came up for final arguments before Hon’ble Justice Mr.C.Kumarappan, were Mr.B.Vijay Advocate assisted by Advocate M.Mohamed Muzammil (Former Government Advocate) and Senior Advocate Mr.A.R.L.Sunderesan, who appeared for the Petitioners (direct DSP’s/AC’s posted in various post in and around Tamilnadu). After hearing the elaborate arguments of all the parites concern and Mr.B.Vijay Advocate assisted by Advocate M.Mohamed Muzammil (Former Government Advocate) and Mr.A.R.L.Sunderesan, on 04.11.2025 Hon’ble Justice Mr.C.Kumarappan delivered judgement. And through which the Hon’ble High Court was pleased to Quash all the GO’s which gave relaxation to the service rule and the temporary panel was drawing the list with Promoted officers. The Hon’ble High Court has directed the Tamilnadu not to issue any further promotions till the inter se seniority list is prepared after following 2:1 ratio and service rules.
