M/s. Selene Estate Ltd., RCP No. 87 of 2025 (TNRERA, Bench 2, Chennai, order dated 07.10.2026): The Complainant, an allottee of Flat F1304 in Tower F-1 of “Ozone Greens”, Perumbakkam, paid Rs. 17,00,686 (about 65% of the Rs. 26,33,380 consideration) under Construction and Sale Agreements dated 14.05.2019, which required possession by 28.02.2019 plus a six-month grace period. The promoter had not delivered possession or obtained a completion certificate even by the date of complaint (06.06.2025), nearly six years after the agreed date. Rejecting the promoter’s pleas of financial crisis, COVID-19, force majeure, allottee defaults and limitation, and finding that its demand for 95% of the consideration had no basis in the payment schedule, the Authority held, relying on Newtech Promoters and Developers Pvt. Ltd. v. State of U.P. (2021), that under s. 18 of the RERA Act, 2016 the allottee may withdraw from the project and claim a refund with interest. It directed the Respondent to refund Rs. 17,00,686 with interest at 10.90% p.a. (SBI MCLR of 8.90% plus 2%) from the dates of the respective payments until repayment, and to pay Rs. 25,000 as litigation costs, both within 30 days. Advocate Mr. M.A. Arshad appeared on behalf of the Complainant.
