The above matter is listed before the Hon’ble Mr. Justice V. Pugalendi, During the course of argument Mr. P. Muthukumar (former Additional Advocate General and State Government Pleader of Tamil Nadu) appeared for the petitioner and submitted that at the time of appointing the Registrar (i/c) the resolution no 18 was not followed the statutory mechanism for Registrar (i/c) mentioned in chapter VI clause 1 and 8(i) of the university statues specifically govern the office of registrar while the registrar is appointed by the syndicate subject to confirmation by the senate where the office falls vacant or the registrar is unable to discharge the duties shall be performed by a person appointed by the Vice Chancellor with the approval of syndicate. The syndicate in its meeting held on 18.08.2023 under Item No.18 specifically resolve that in future, only a faculty member belonging to the professor cadre alone shall be appointed as nodal officer in charge. The said resolution constituted by the university binding administrative decision governing such appointment including the post of registrar (i/c) the syndicate resolution dated 18.08.2023 was not properly followed by the university at the time of appointing the Registrar (i/c). In the meantime, the registrar presently holds two post such as Registrar (i/c) and Controller of Examination which is totally contrary to Item No. 32/2021 of syndicate resolution. Moreover, the appointment of Registrar (i/c) was approved by the syndicate committee (which consist of only 2 members) and not by the syndicate (which consist of 21 members). Further submits that the central university rules and guideline cannot be applicable to the state university unless it was accepted by the state government and syndicates. Upon hearing arguments of M/s. P. Muthukumar Counsel for Petitioner, His Lordships Hon’ble Mr. Justice V. Pugalendi has reserved this matter for orders.
