Respected Hon’ble Chief Minister,
Vanakkam.
I respectfully submit this representation seeking the effective implementation of horizontal reservation for transgender persons in Tamil Nadu, in line with the judgment of the Hon’ble Madras High Court in Rakshika Raj vs. State of Tamil Nadu (W.P. No. 6967 of 2022, decided on 8 April 2024). The Hon’ble Court quashed G.O.Ms. No. 28 dated 06.04.2015 and directed the Government to provide horizontal reservation for transgender persons in accordance with the principles laid down by the Hon’ble Supreme Court in NALSA v. Union of India (2014).
This landmark judgment recognizes that transgender persons constitute a distinct gender identity and should not be restricted to a caste-based reservation category. It affirms the constitutional principles of equality, dignity, and equal opportunity.
I humbly request your Government to take the following steps:
1. Issue a comprehensive Government Order implementing horizontal reservation for transgender persons in all State Government recruitments and appointments.
2. Extend the benefit of horizontal reservation to all Government Departments, Public Sector Undertakings, Local Bodies, Universities, Government Hospitals, and Educational Institutions.
3. Ensure that recruitment notifications clearly mention the reservation available for transgender applicants.
4. Establish a monitoring committee to oversee implementation and address grievances related to reservation.
5. Conduct awareness and sensitization programmes for recruiting authorities to ensure fair implementation.
As a transgender woman, I have personally experienced barriers in accessing employment despite possessing the required educational qualifications. Many qualified transgender persons across Tamil Nadu continue to face similar challenges. Proper implementation of the Hon’ble High Court’s judgment will provide deserving candidates with equal opportunities to contribute to the development of our State.
Your leadership has the opportunity to make Tamil Nadu a national model for transgender inclusion by ensuring that the constitutional rights recognized by the Hon’ble Supreme Court and the Hon’ble Madras High Court are fully realized in practice.
I therefore humbly request your kind intervention to implement the judgment at the earliest and ensure that transgender persons receive the benefits of horizontal reservation in all Government employment and educational opportunities.
