ORDER

      Learned counsel for the petitioner would submit that the petitioner is working as Assistant Executive Engineer in Coimbatore Electricity Distribution Circle, Coimbatore.  One Purushothaman made 8 online applications dated

04.06.2025 on behalf of one Venkatesh and Bharathi, seeking 3-Phase domestic

Electricity service connection for the dwelling house situated at Vasavi Garden, Sundakamuthur Road, Coimbatore, which consists of 13 dwelling units.  The said applications were made without enclosing building completion certificate. Thus, the said applications were kept on hold and the same was also intimated to the aforesaid Purushothaman.  Under these circumstances, he made a false complaint before the National Commission of Scheduled Caste against the petitioner alleging that she did not provide the electricity connection to the said building, since he belonged to scheduled caste.  Subsequently, the second respondent directed the petitioner to provide connection by taking into consideration as special case subject to certain conditions such as to submit indemnity bond and undertaking letter to produce building completion certificate later.  Accordingly, the petitioner extended the electricity supply for 8 dwelling units.  However, the third respondent has passed the transfer order dated 13.01.2026 by transferring the petitioner to the office of Assistant

Executive Engineer (Electrical) Shift, Thudialur, 230KV SS, Coimbatore Electricity Distribution Circle (North), Coimbatore.   Challenging the said transfer order, the petitioner has come forward with the present writ petition.

2.  Considering the prima facie case made out by the petitioner, there shall be an order of interim stay, till the final disposal of this writ petition.   Further this Court directs the second respondent to appear before this Court in person and explain on what capacity he issued a recommendation to the petitioner to effect the service connection without a Building Completion Certificate.
