For non-compliance of the order of the Writ Court, a statutory notice came
to be issued on 12.09.2022, directing the respondent to be physically present before this Court today.
- Though notice was served on the respondent, he has failed to appear
today. Rather, Tmt.S.Viji, Personal Assistant to the Sub-Collector, Mettur, Salem District, is present before this Court today.
- The learned Government Advocate submitted that the respondent herein
had filed an application in Sub Application No.555 of 2022, seeking for dispensing with his appearance. In the affidavit filed in support of the said application, it is stated by Mr.Veer Pratap Singh, The Sub Collector, Mettur, Salem District that on the instructions of the District Collector, Salem to accompany him for a case before the National Commission for Schedules Castes at New Delhi, he had gone to New
Delhi and therefore has expressed his inability to appear before this Court today.
- Effectively, the respondent herein had chosen to comply with the order
of the District Collector to accompany him to New Delhi, instead of appearing before this Court, in response to a statutory notice issued. I am not inclined to accept the explanation given by the respondent, for his inability to appear before this Court and hence, the application in Sub Application No.555 of 2022 stands dismissed.
- Though the learned Government Advocate would submit that the orders
of the Writ Petition has now been complied with, I am not inclined to condone the delay in complying the orders, since the respondent herein is alleged to have disobeyed the orders of the Writ Court earlier and has once again disobeyed by not complying with the statutory notice.
- Hence, issue bailable warrant to secure the presence of Mr.Veer Pratap
Singh, The Sub Collector, Mettur, Salem District, who is now serving as an Additional Collector, Tiruvannamalai District.
- The Superintendent of Police, Tiruvannamalai District is called upon to
secure the present of Mr.Veer Pratap Singh, I.A.S., and physically produce him before this Court on the next date of hearing, i.e., on 15.11.2022.
- Post this matter on 15.11.2022.
