The President/Secretary, All Bar/Advocate Associations, Tamilnadu and Puducherry. CIRCULAR Sir/Madam, Sub: Requesting the fullest co-operation of the Members of the Bar/Advocate

To

The President/Secretary, All Bar/Advocate Associations, Tamilnadu and Puducherry.

CIRCULAR
Sir/Madam,

Sub: Requesting the fullest co-operation of the Members of the Bar/Advocate
Associations to the initiative and orders of the Hon’ble High Court – Reg.

Ref: Orders passed by the Hon’ble High Court of Madras in W.P. Crl. No. 618/2025 and by the Madurai Bench of the Hon’ble High Court of Madras in W.P.Crl.(MD). No. 1014/2025, dated 18.08.2025.
——–
1. The State Bar Council of Tamil Nadu and Puducherry has been
appraised about the recent initiative undertaken by the Hon’ble High Court of
Madras in Roc.No.148/2025/Crl.Side and its consequential orders passed in
Suo Motu W.P.Crl.No. 618/2025 and W.P.Crl(MD).No.1014 of 2025, dated:18-08-
2025 respectively, wherein the Hon’ble High Court has constituted a dedicated
Bench to settle and dispose Criminal cases involving offences punishable with
2

imprisonment up to three years pending at the stage of Trial, Appeal or Revision for more than three years throughout the State of Tamil Nadu and Puducherry.
2. The State Bar Council understands that this initiative has been taken by the Hon’ble High Court to deal with the issue of long pendency of criminal cases before the learned Trial Courts and the Sub-ordinate Judiciary.
3. The members of the Bar must co-operate and render their valuable
assistance to the Hon’ble High Court to succeed in their initiative. But it is reliably understood that some of the Bar/Advocate Associations have passed resolutions agitating against this initiative of the Hon’ble High Court. Hence, the Bar Council, request all the Bar/Advocate Associations to refrain from passing any resolutions against the order of the Hon’ble High Court and further, we request all the Associations, its members and the legal fraternity to co-operate with the orders of the Hon’ble High Court to solve the issue of long pendency of criminal cases in the State of Tamil Nadu.
4. It is pertinent to denote that one of the biggest difficulties faced by our Indian Judiciary is the long pendency of unsettled cases and to curtail the same, the Members of this Noble profession must co-operate and render their full assistance to the Hon’ble High Court. The Hon’ble High Court of Madras exercising its “Parens Patriae Jurisdiction” has taken its step to deal with the long pendency of cases in the State of Tamil Nadu and Puducherry and this initiative of the Hon’ble High Court will have a very effective change in the pendency of criminal cases. For these steps to be effectively implemented, the

role of advocates becomes a necessity and hence, the advocates must render their fullest co-operation in disposing the pending cases and all the Bar/Advocate
Associations may indicate the Hon’ble High Court of any pending cases that would fall under the aforesaid criteria for its effective adjudication.
Therefore, the Bar Council of Tamil Nadu and Puducherry hereby request all the members of the Bar/Advocate Associations throughout the State of Tamil Nadu and Puducherry, its office bearers and the legal fraternity to render their fullest co-operation to the initiative and orders of the Hon’ble High Court in disposing the long pending criminal cases for offences punishable with imprisonment upto three years.
Thanking you,
Yours faithfully,

SECRETARY, BAR COUNCIL.
