Order
(Order of the Court was made by S.M.Subramaniam J.)
This Court passed an order on 08.01.2025 for initiation of action against the corrupt activities in large scale occurred in Central Prison at Madurai. A criminal case has been registered in Crime No. 15 of 2024 on 12.12.2024 for
offences under Sections 120B, 467, 468, 471, 167, 409 PC and 13(2) read with 13(1 )(a) of the Prevention of Corruption Act, 1988. Two years lapsed and investigation is under progress.
2. Learned Additional Public Prosecutor would submit that the Vigilance and Anti Corruption Wing requires some more time to complete a detailed enquiry. However, the Department of Vigilance and Anti Corruption Wing has not filed any report regarding the progress made in the investigation. Compliance report has been filed by the Government which would state about the actions initiated.
Learned counsel for the petitioner would submit that one accused officer in the rank of Assistant Superintendent of Police was reinstated based on an order in the writ petition directing the authorities to dispose of the representation. Having considered the seriousness involved and causing prolongation of investigation, it would pave way for the accused persons to escape from the clutches of law. Therefore the officials are expected to expedite the investigation by sensitising the seriousness of the corruption charges framed against the officials and other persons in the prison department.
4. Learned Additional Public Prosecutor would submit that the Government would form a special team to expedite the investigation and to file a final report before the competent court of law.
5. In view of the said submission, the respondents are directed to constitute a special team headed by a senior IPS level officer, who in turn shall expedite the investigation and ensure that the final report is filed before the competent criminal court of law within a period of four months from the date of receipt of a copy of this order. Investigation in all respects shall be completed and final report is to be filed within the said period. In the event of failure on the part of the Department of Vigilance and Anti Corruption and the
C
State, this Court has to necessarily consider for transfer the investigation.
Departmental disciplinary actions initiated shall also go on simultaneously.
6. Pendency of criminal proceedings is not a bar for continuation of departmental disciplinary proceedings under the Discipline and Appeal Rules Thus, the Government shall collect the documents and proceed with the departmental disciplinary proceedings by framing charges under the relevant rules and proceed with the matter and conclude the same as expeditiously as possible. The respondents are directed to comply with the above directions. In the event of any failure on the part of the respondents, the petitioner is at liberty to reopen the case by filing an appropriate petition.
