Suo-moto contempt petition: 613 of 2019 was initiated by the Honble high court against The chairman Tamilnadu Uniform service Board and N.K. Senthamarai kannan member secretary.
Suo- moto case:
One Mr. Arunachalam filed a case By writ petition against TNSURB for his non selection and a wrong answer published by the board.
The Honble high court issued directions to Tnusrb for submitting an expert opinion. The TNUSRB sought explanation from one D. Murthy who introduced himself as a professor in IIT, Madras. Believing that he is a professor in IIT, the board has taken a opinion from him and submitted to the Hon’ble high court of Madras. Based on the opinion furnished to the court, the Honble high court has dismissed the writ petition filed by Arunachalam. Later the said Arunachalam sought an information through RTI to IIT and received the information that no professor in the name of D. Murthy in IIT. The said Arunachalam submitted the reply he received from IIT and the case which was dismissed reopened and justice S. M. Subramanian initiated suo-moto criminal contempt and the same was referred to the bench for further proceedings. Hon’ble division bench consisting of justice P.N. Prakash and justice hemalatha after hearing elaborated arguments held that they are convicting the board for contempt and imposed a fine of 2000/- to be paid to registrar of high court and discharged Mr. N.
