[1/6, 23:51] Sivaji: 7 – 1 – 21 Shivaji, MHC advocate: the constitution of India entrusted the sovereign power with the people. how the people exercise their sovereign power in India.they have three ways one is through universal adult franchise ( the first past the post system) and another one is through referendum and last one through knocking the doors of judiciary intervention. though the sovereignty lies with people they do possessed only limited access. when the question arises ” PEOPLE Vs- CONSTITUTION ” the voice of people shall extents only within the framework of constitution that is the constitution is prevail over the will of the people. In India the constitution alone is supreme and none of its organs is supreme including judiciary, though the judiciary is only gaurdian of the constitution and it’s power of interpretation is limited towards constitution, when there exists any ambiguity with reference to laws enacted by parliament vis-a-vis to the constitution, but the power of interpretation of judiciary towards laws enacted by parliament is absolute……….. thanks .. follows
