Honble full bench consisting of Honble Mr. Jutsice P.N. Prakash, Mr. Justice G. JAYACHANDRAN and Mr. Justice N. Sathish Kumar, spent their valuable time patiently hearing the matter at length and reserved the case for orders in as to how to proceed the investigation further. The Honble court also further said that the primary motive is only to find the accused and punish him in accordance with law. The state was directed to file a response for the report of the special investigation team before 18.01.2021.

The habeaus corpus petition filed by R. Sankarasubbu, MHAA, TNAA and p.s amalraj on sankarasubbu’s sons mysterious death of murder. Senior counsel S. Prabakaran on behalf of sankarasubbu submitted that the son of advocate sankarasubbu was murdered by unknown persons and have dumped him in ICF lake. The investigation was taken up by the CBI way back in the year of 2011 and since nothing was fruitful the Honble high court of Madras has set up a special investigation team comprised of various officers and since then it has become the high court monitored probe and even after years there is no result has to who committed the crime, but the investigation seems to be futile exercise and no further process. Senior Advocate Mr. S. Prabakaran further submitted that there are serious lapses and it appears that there is involvement of senior police officials and that is the reason why the investigation is not in a proper manner. Further the special investigation team has submitted several status report numbering 24 and in the status report it was found that 8 officials involvement and sought a prayer to the court that unless those officials are not interrogated by taking them under custody, the truth cannot be unearthed and insisted for such prayer and direction from the court. Senior counsel further submitted that the Honble supreme court time and again held that article 21 is more important comparing with crpc,, investigation agency cannot close on the basis of technicalities. The supreme court has held that the monitoring agency should be satisfied with the investigation report before it could be filed in the concerned jurisdictional court. The senior counsel Mr. S. Prabakaran submitted that there were as many as 4 different teams of 2 CBI and 2 special investigation teams under the monitoring of the Honble High court and it is only after special investigation team was set up, the case went on a right direction and the case of murder was confirmed. Then the senior counsel pointed out various settled preposition of law, while court monitored probe. This attack on the lawyer was revenge on he discharging his professional duty, if a lawyer is targetted as such no lawyer can practice in a free and fair manner and his life would always under threat and stake and would lead to a disaster. The learned senior counsel submitted that the full bench consisting noble and humble judges who have great experience in law and with folded hands requested the court to monitor the case and direct the investigation teams to give justice to the poor father after all he lost his loveable son, who has no other greater loss.
