Dalit rape: Why the road to justice is so rocky
Dalit women face several obstacles from registering FIRs to court delays. Activists explain that in 99% cases, the police hand over an acknowledgement of a non-cognisable offence instead of an FIR under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. Often the case is not registered under the PoA Act and the caste nexus in the village poses a big hurdle.

CHENNAI: More than five months after 10 Indonesian nationals who came to the country to attend the Tablighi Jamaat conference and were booked under sections of the Foreigners’ Act and Epidemic Diseases Act for flouting norms in Kancheepuram after the pandemic outbreak in the country, a district court has let them off, slapping a fine of Rs 1000 each on them.
During the final hearing, the court held the foreigners guilty of the offences and sentencedthem of one monthsimple imprisonment, but held that since the offenders had already spent the time in camp and isolation, they can be set at liberty after payment of fine.
The court also let off two Assamese men who were also detained along with the foreigners, after asking them to pay a fine. In the first week of April, Vishnu Kanchi Police had detained10 Indonesian nationals and two from Assam.
According to the prosecution, “The 10 Indonesians had come to India to participate in a religious congregation, when there was spread of Covid-19 in India. After the congregation, the Indonesians along with the duo from Assam, visited Kanchipuram and stayed in a mosque and preached religious ideologies in and around Kanchipuram, despitelockdow.” The prosecution submitted one of the foreign national was tested positive for Covid-19 and despite that they roamed around without self-isolating themselves.
Apart from the Foreigners’ Act and Epidemic Diseases Act, the foreign nationals were also booked under sections of the Disaster Management Act and the Tamil Nadu Public HealthAct. Sincethosebooked are not awareof either English or the local language, translators were arranged and the charges were read to them.
“All the accused admitted to the offence saying that they were unaware of the regulations and orders of government authorities in India and that they were in camp for the past few months and their families have suffered a lot in the period,” JudicialMagistrate,R Senthil Kumar noted and held that some leniency can be shown towards the foreign nationals as they had come down here, unaware of the pandemic situation and that there were also language constraints.
The magistrate directed the state authorities to return their passports and mobile phones.
