ORDER
When the matter was taken up for hearing today, Mr.Vijayaraghavan, learned counsel for the Insurance Company filed the synopsis containing the earlier orders passed by this Court and also the areas which requires immediate action. The learned counsel also filed additional typed set of papers containing all the relevant documents.
2.The learned Standing Counsel appearing on behalf of the Tamil Nadu
State Legal Services Authority also filed the report received from the learned
Principal Sub Judge, Hosur dated 25.08.2025 and the learned Additional District Judge, Hosur dated 26.08.2025.
3.Heard counsel for the petitioner and the learned counsel for the respondents.
4.The learned counsel for the petitioner submitted that a total of 467 cases have been identified for which complaints have been given and all these 467 complaints must translate itself into FIRs and those FIRs must be transferred to the Special Investigation Team [SIT]. The tabulation prepared by the learned counsel for the petitioner shows that the 467 complaints involves a total sum of Rs.105,23,56,770/-. The learned counsel submitted that this amount is only a minuscule sample of the large scale scam that is involved in the present case and the SIT will have to commence the investigation atleast insofar as 467 complaints are concerned.
5.The report submitted by the Tamil Nadu State Legal Services Authority shows that a total of 65 cases are pending before the Principal Sub Judge, Hosur and 4 cases are pending before the Additional District Judge, Hosur and all the other cases have been dismissed for default.
6.The learned Additional Public Prosecutor appearing on behalf of the respondents seeks for sometime to file a detailed report in this case.
7.Considering the materials placed before this Court and after hearing the learned counsel appearing on either side, the following directions are issued by this Court:
(a) The respondents shall ensure that the 467 complaints which have been given in the respective Police Stations and which has been tabulated, shall be taken on file and FIRs shall be registered and all the FIRs shall be transferred to the SIT. This process shall be completed within a period of four weeks from the date of receipt of copy of the order.
(b)In the earlier order passed by this Court on 18.04.2022, this Court had taken note of the fact that the documents that were filed before the Motor Accident Claims Tribunal in 82 MCOP cases are missing and was not able to be traced. Hence, this Court directed the concerned Court to immediately commence an enquiry and ensure that the documents that were filed along with the MCOP is kept intact and it is not returned back either to the parties or to their counsel. The report submitted before this Court is silent on this issue.
This Court directs the learned Principal Sub Judge, Hosur and the learned Additional District Judge, Hosur, to take note of this direction and submit a report before this Court.
