AFFIDAVIT FILED BY THE PETITIONER

I, R.KUZHALI, Daughter of C. Ragupathi,, Hindu , aged about 23 years, residing at No.10/183-4, Anbhazhagan Thottam, Thiruvikanagar, Harur Post & Taluk, Dharmapuri District-636903 temporarily came down to Chennai and do hereby solemnly affirm and sincerely state as follows:-

1. I am the petitioner herein and as such I am well acquainted with the facts of the case.

2. I humbly submit that I am the student of Anna University and have completed my Bachelor of Technology in Biotechnology bearing registration Number: 312315214028 and passed out in the year 2019 with the 85.8% of Marks. I appeared for the GAT-B exams held in 2020 seeking admission into post graduate Bio technology courses. I had scored a mark of 132 out of 240 and obtained a rank of 156 under the unreserved category.

3. I submit that I have applied for admission into M. Tech (Bio Technology) and M. Tech ( Computational Biology) both courses conducted by the Centre for Bio Technology, Anna University, Chennai. The course is funded by the Department of Bio Technology, Ministry of Science and Technology, Government of India. My application number is 90160. The last date for application is 31.10.2020 and I have applied well within the deadline. I was confident of getting admitted into the course as I had scored sufficient marks to secure an admission.
4. I submit that to my utter shock and surprise the Anna University issued a press release dated 29.01.2021 stating that they are not conducting the two courses M. Tech (Bio Technology) and M. Tech ( Computational Biology) this year due to a dispute regarding the quantum of reservation that has to be followed while admitting the students. As the Central Government rules of reservation were not acceptable to the Government of Tamil Nadu, the Anna University is unable to proceed with the admission to the DBT- supported M.Tech Biotechnology and M.Tech Computational Biology Programmes for the academic year 2020-21 and the same is posted on their official website by order.
5. I submit that the decision to scrap the courses this year due to this dispute reeks of arbitrariness and unfairness. Both the state and central governments ought to have resolved this issue and ensured that the courses are conducted. There are around 45 seats in both the courses combined and this decision not to conduct courses this year will impact the lives of these 45 students in both the courses. It is highly improbable that a course can be scrapped due to a difference of opinion between two agencies.

6. I submit that the Central Government’s insistence that the Anna University follow only 49.5% reservation and not the state Government’s 69% Quota Policy in admitting the students is arbitrary. As the infra structure is that of the State Government. The salaries for the staff and the teaching faculty is paid by the State Government. It is further submitted that the Central Government’s Department of Biotechnology funds the courses of M.Tech Biotechnology and M.Tech Computational Biology Programme and also offer Rs.12,000/- and Rs.12,500/- respectively as stipend to a total of 45 Students. This will not give them any right to insist that only 50% reservation policy should be followed.

7. I submit that this decision has left all the applicants in a dire and dicey situation. The students who have prepared hard for the course and taken the GAT-B examination are left with an empty future to grapple with. It will not be out of place to point out that after the advent of the COVID Pandemic the demand for these courses had gone up.

8. I submit that the M-Tech Biotechnology Courses is being offered Since 1985 at Anna University and M.Tech Computational Biology has been on from 2014-15. The students who have successfully cleared the GAT B exams are extremely disappointed by the decision of the Anna University. It is submitted that Tamil Nadu Government wanted 69% reservation whereas the Central Government insisted on 49.5% reservation. Due to this conflict over the quota policy, the admissions which should have been completed a month ago has been postponed by the Anna University the admissions to M Tech biotechnology in other institutions got over. The students who like myself who have secured a good rank and was very optimistic about getting admitted in the prestigious Anna University also have lost out on the opportunity to join any other university.

9. I submit that until last year, the admission for these two courses were conducted at the all India Level. Jawaharlal Nehru University in New Delhi used to conduct Combined Entrance Exam for Biotechnology(JNU CEEB) for admitting students at M Tech biotechnology while Pondicherry University used to conduct all India entrance test for computational biology course. This year, the Regional Centre for Biotechnology in Faridabad took over the responsibility of conducting both the entrance exams and the name of exam was also changed as Graduate Aptitude Test in Biotechnology (GAT-B) . Instead of conducting both entrance test and admissions, the RCB announced that the admissions would be conducted by the respective Institutions.

10. I humbly submit that the regional Centre for Biotechnology is conducting the Graduate Aptitude Test – Biotechnology ( GAT-B), an eligibility test for admission to the DBT- SUPPORTED pg Programmes in Biotechnology in participating institutions. This test replaces combined Entrance Examination in Biotechnology (CEEB), conducted previously by JNU based on the examination score, an All –India Category-wise merit list with GAT-B rank will be generated. Using the rank, the candidate may apply to various DBT-Supported PG Programmes in participating institutions. The participating institutions will advertise these programmes and admit students as per their admission & selection process. Hence the cancelling the Admission to M. Tech. ( Biotechnology)/ M.Tech ( Computational Biology) Degree Programmes for Academic year 2020-2021 by the third Respondent is arbitrary, illegal and the same liable to be quashed.

11. I submit that since it is a central government sponsored course DBT followed 49.5% reservation in all India admission till last year. We have reliably come to understand that the Anna University sought clarification from the State Government over the reservation Policy to be followed in admissions to these two programmes. The State Government directed the university to follow 69% reservation, for which the Department of Bio Technology, which funds these course refused. Due to this tug of war between two agencies our future is at stake.

12. I submit that the non conduct of the course for a year will not only put our futures at stake but also affect the continuity of the course. Now 2nd year students are continuing the course and for them the 2nd year comprises only of projects. This year they will complete the course and in the next year there will not be any students to continue the ongoing projects done by Department of Bio Technology, Anna University.

13. I submit that it will cause grave prejudice and irreparable hardship if the courses are not conducted this year. It will put our futures at risk as we will be losing one year. I submit that it is the responsibility of both the State government and the Central Government to resolve the dispute among themselves and ensure the conduct of the courses. It is with great hardships and difficulties these courses have been brought into existence. They are prestigious course and paves way for world class researchers in the field of bio technology. These courses were brought in so that the students from the state will have access to cutting edge developments in the field of Bio Technology which is a most sought after field of research.
14. The petitioner submits that the petitioner is left with no other efficacious alternative remedy except to approached this honourable court under article 226 constitution of India by filing the writ petition in W.P.No.2189 of 2021 as follows;-
“ it is humbly prayed that this Honourable Court may be pleased to issue a WRIT, ORDER OR DIRECTION in the nature of a WRIT OF CERTIORARI Calling for the records pertaining to order dated 29.01.2021 published in the 5th respondent’s website www.biotechannuniv.com issued by the 5th Respondent cancelling the Admission to M. Tech. ( Biotechnology)/ M.Tech ( Computational Biology) Degree Programmes for Academic year 2020-2021 passed by the 5th Respondent and quash the same and pass any other order that maybe deemed fit under the circumstances of the case and thus render justice”.
16. I humbly submit that on 19.02.2021, this Hon’ble High court was allowed the batch of writ petition filed by the students in W.P.No.2189, 2764, 2771, 3106, 3109 & 3081 of 2021 and passed the following order;-

“ In view of this stand taken by the respondents, this Writ Petition is allowed and the impugned order is set aside with a direction to the respondent/University to admit students as per the Government of India norms, as it is wholly sponsored by the Government of India. The AICTE and the first respondent shall coordinate with the respondent/Anna University to continue this course for this academic year without any break. The first respondent shall complete the selection process and communicate the eligible candidates to Anna University within two weeks. The AICTE shall accord approval of extension of admission beyond the cutoff date.”
18. I humbly submit that the M. Tech (Bio Technology) 25 seats and M. Tech ( Computational Biology) 20 seats totaling 45 seats and both courses are conducted by the Centre for Bio Technology, Anna University, Chennai and total six writ petition in W.P.No.2189, 2764, 2771, 3106, 3109 & 3081 of 2021 has been filed and among them only two writ petitioner has got admission namely R.Chithra and D.Vikram. The 5th respondent has only filed 6 seats in M. Tech (Bio Technology) and 6 seats in M. Tech ( Computational Biology) and thereby filled only 12 seats against the available 45 seats. Hence 33 seats were left vacant.

I humbly submit that in the above circumstance, I have sent a e-mail dated 23.03.2021 requesting the 1st respondent to release the 2nd list for filling the remaining vacant seat since My rank in the exam is 156 with score 132 which is above the cut off mark fixed by the 1st respondent and I am being fully eligible for admission in M.Tech (Biotechnology) and also sent the representation to the 3rd respondent to extent the cutoff date of admission of students into the 5th respondent university through my email dated 25.03.2021. But all our attempts are vent in vein. Hence this Writ Petition.

20. I humbly submit that on 22.03.2021, the first respondent has replied that the Anna University may shortly operating the waiting list for admission to DBT in M. Tech (Bio Technology) and 6 seats in M. Tech ( Computational Biology) programmes for GAT B -2020 qualified candidates for academic year 2021.

21. I humbly submit that for my shock and surprise, I have got another mail dated 24.03.2021 from the 1st respondent stated that the Anna University has permission for admission from AICTE up to 20th March 2021 only and thus they could not release the second waiting list. The Anna University has sought permission from AICTE for extension of admission dates. If approved, second waiting would be published on University website soon. Hence this Writ Petition.

22. I humbly submit that hence, I have sent an email to the 3rd respondent to approve the extension of deadlines, so that 5th respondent / Anna University could release the second list of students which will help us in joining the course and requested to consider the same. But all our attempts are gone in vain. Hence I am filing this writ petition in the interest of Justice. If the 3rd respondent extended the dead line for admitting the students into the 5th respondent university, no prejudice is going to cause to the respondents.

23. I humbly submit that the State Government directed the university to follow 69% reservation, for which the Department of Bio Technology, which funds these course refused. Due to this tug of war between two agencies our future is at stake. This is the intentional lack of action to release the second list to avoid the further admission and the 1st and 5th respondent being adamant from the initial stage of proceedings for the reason best known to them and they are not bothering the future of the students.

24. I humbly submit that in the above circumstance, it has become necessary for the intervention of this Hon’ble court to issue appropriate direction to fill the remaining vacant 19 seats in M. Tech (Bio Technology) and 14 seats in M. Tech ( Computational Biology).

25. The petitioner craves leave of this Hon’ble Court that she may be permitted to raise additional grounds at a later stage, if necessary.

26. The petitioner submit that the balance of convenience is in favour of the petitioner and no grave prejudice will be caused to the respondents if the appropriate directions are issued to fill the remaining vacant 19 seats in M. Tech (Bio Technology) and 14 seats in M. Tech ( Computational Biology) disposal of this Writ Petition.

27. I submit that I have no other alternative and efficacious remedy except to invoke the jurisdiction of this Hon’ble Court under Article 226 of the Constitution of India for issuance of a Writ of Mandamus.

For the foregoing reasons it is prayed that this Hon’ble Court may be pleased to issue INTERIM DIRECTION, directing the 3rd respondent to extend the cutoff date for admission of students in remaining 19 seats in M. Tech (Bio Technology) and 14 seats in M. Tech ( Computational Biology)Degree Programmes conducted by the 5th Respondent for the Academic year 2020-2021 pending disposal of the above writ petition and thus render Justice.

I therefore pray that this Hon’ble Court may be pleased to issue a WRIT OF MANDAMUS or any other appropriate writ, order, or direction in the nature of a Writ, directing the 1st respondent to release the 2nd list of students for admission of 19 seats in M. Tech (Bio Technology) and 14 seats in M. Tech ( Computational Biology) Degree Programmes conducted by the 5th Respondent for GAT B -2020 qualified candidates for academic year 2020-2021 and direct the 5th respondent to admit students accordingly and pass any other order that maybe deemed fit under the circumstances of the case and thus render justice.
