Heard the learned Senior Counsel for the first petitioner, the learned counsel for the petitioners 2 to 7 and the learned Additional Advocate General assisted by the learned Government Advocate for the respondents.
2.The land had been acquired for creating amenities for the devotees thronging Arulmighu Dhandayuthapaniswamy Temple, Palani.
By the impugned communication, the first petitioner had been called upon to receive the award amount.
3.The learned Senior Counsel for the first petitioner highlights quite a few procedural lapses. While we do endorse the said submission, we are of the view that the clock cannot be put back. Possession of the land has already been taken. The only way we can protect the petitioners’ rights is by safeguarding their right to seek enhancement of compensation.
4.The petitioners through their counsel undertakes to provide the account details to the concerned authority. On receipt thereof, the award amount shall be credited to the petitioners’ bank account. From the said date, the limitation for seeking enhancement will commence. The petitioners will have to give their written application to the first respondent under Section 65 of the Central Act 30 of 2013 for reference. The first respondent will make the reference within a period of eight weeks thereafter. The jurisdictional Civil Court will take the same on file and give a disposal within a period of one year thereafter. The direction given in this writ petition would apply to other similarly placed land losers also.
5.This writ petition is disposed of accordingly. No costs.
Consequently, connected miscellaneous petition is closed. .
