The writ petition has been filed by the All India Private Educational Institutions Association seeking protection for private unaided schools in Tamil Nadu, which depend entirely on approved fee collections for their operation.
The Association contends that following the Division Bench judgment in W.A. No. 3075 of 2021 dated 19.07.2024, schools are no longer permitted to withhold Transfer Certificates (TCs) from fee-defaulting students in Classes IX to XII. As a result, schools have been deprived of their only practical fee-recovery mechanism while remaining subject to statutory fee ceilings and a prohibition on collecting any amount beyond approved fees.
The petition argues that civil suits for recovery of school fees are commercially unviable, time-consuming, and therefore constitute an illusory remedy. The Association seeks judicial intervention for creation of an effective fee recovery mechanism.
Reliefs Sought
The petitioner seeks directions to:
1. Consider and dispose of its representation dated 06.04.2026.
2. Constitute an Expert Committee to formulate a Fee Protection Policy and Summary Recovery Mechanism.
3. Direct the Fee Determination Committee to factor “default risk” while fixing school fees.
4. Pass appropriate consequential orders.
