PRAYER; This writ petition has been filed under Article 226 of Constitution of India, to issue a writ of Certiorarifiled Mandamus, to call for the records pertaining to the impugned communication vide.Na.Ka. No. 1506/ E/ 2024 dated 28.10.2024 issued by the 4th Respondent and quash the same and
consequently direct the respondents 1 to 5 to provide the welfare fund of Rs.50 ,000 /- (Rupees Fifty Thousand only) and 8 gram Gold Coin to the
petitioner, based on the petitioners application dated 29.07.2019 vide. Account Number (CAN) 0330413046107 and Receipt No.20190100087936, under the scheme of the Tamil Nadu Moovalur Ramamirthammaiyar Ninaivu Marriage
Welfare Fund.

Challenging the communication issued by the 4th respondent dated
28.10.2024, the petitioner has filed the present writ petition.
2. It is the case of the petitioner that the petitioner got married on
01.09.2019 and she had two children. She belongs to Hindu Adi Dravidar Community and she holds a Master degree in Mathematics. When her marriage was fixed, the petitioner has made an application on 29.07.2019 for getting benefits under the scheme of ”Tamil Nadu Moovalur Ramamirthammaiyar Ninaivu Marriage Welfare Fund” along with respective documents before the respondents. Even after lapse of more than six years, the petitioner did not get a
benefit of the scheme wherein the Government provided gold and a sum of Rs.50,000/-. Though the petitioner ran from pillar to post meeting the various revenue authorities, no stone was moving. While being so, on 03.09.2024, the petitioner gave a representation to the respondents to provide the welfare fund
of Rs.50,000/- and a gold coin under the said scheme. On 28.10.2024, the 4th
respondent has informed that in view of the Government order dated 28.11.2023, the scheme of Moovalur Ramamirthammaiyar Ninaivu Marriage Welfare Fund has been converted into the Moovalur Ramamirtham Ammaiyar Higher Education Assurance Scheme. Aggrieved by the same, the petitioner has
filed the present writ petition.
3. The learned counsel for the petitioner submitted that she made application on 29.07.2019. However, the new scheme was launched on 05.09.2022. The fault is on the respondents, who kept the application pending for more than six years without providing the benefit under the said scheme.
Therefore, the learned counsel prays allow the writ petition.

The learned Special Government Pleader submitted that though the petitioner made application in the year 2019, there are several applications pending under the Moovalur Ramamirthammaiyar Ninaivu Marriage Welfare Fund scheme. The Government has converted the said scheme to Ramamirtham Ammaiyar Higher Education Assurance Scheme in the year 2023. To that effect,
the Government order in GO.Ms.No.46, Social Welfare and Women Employment (SW3(2) Department, dated 02.08.2022 has been passed. At this
juncture, the applications which was pending under Moovalur Ramamirthammaiyar Ninaivu Marriage Welfare Fund, cannot be granted.
Hence, the learned counsel prays to dismiss the writ petition.
5. Heard both sides and perused the materials available on record.
6. It is only because of the lethargic and in-action on the part of the revenue authorities that the petitioner was not extended the benefit of the scheme. The petitioner has made online application in the year 2019 and she has produced all the relevant records that are necessary to avail such benefit of the said scheme. Even then, the petitioner was not provided any benefits. The learned Special Government Pleader is also not in a position to explain as to why the petitioner’s application is kept pending for more than 6 years. The Government order dated 28.11.2023 suggest that the marriage assistance scheme has been converted into higher education assurance scheme. However, the petitioner made her application in the year 2019. No satisfactory explanation has been made by the Government. In the absence of the same, the petitioner
cannot be burden with the defects now raised by the Government.
7. Therefore, this Court holds that the petitioner is entitled for 8 grams of Gold and a sum of Rs.50,000/- as provided in the erstwhile scheme viz., Moovalur Ramamirthammaiyar Ninaivu Marriage Welfare Fund scheme.
Accordingly, the first respondent is directed to give or release 8 grams of Gold and deposit a sum of Rs.50,000/- to the account of the petitioner within a period of one week from the date of receipt of a copy of this order, failing
which, serious view will be taken in this matter.
8. With the above observation, the writ petition is allowed. No costs.
