However, it is made clear that the inquiry under Sec 81 of the Act can go on and a report shall be submitted by the inquiry officer within a period of 8 weeks from the date of receipt of copy of the order. Needless to say that further action on the report shall proceed strictly in accordance with law. 29.In the result, both the writ petitions are allowed on the aforesaid terms. No costs. Consequently, the connected miscellaneous petitions are closed.

The 7-judge Constitution Bench of the Supreme Court unanimously ruled that MPs and MLAs do not enjoy immunity from criminal prosecution for offences of bribery. The Hon’ble governor @lokbhavan_tn must seriously note political developments from post-poll events until now and consider directing an impartial, independent vigilance enquiry into alleged accusations of horse-trading to dispel public doubts. The Parliament should consider amending the law to mandate that any MP or MLA who resigns from their seat should be barred from contesting the resulting by-election for a specified cooling-off period, thereby reducing the incentive to vacate seats for shifting alliances.
