Petitioner P Jothibasu had sought various information about the method of procurement done by the Respondent /Tamil Nadu Co-operative Marketing Federation (TANFED) under RTI Act since .02.05.2023 onwards. The same was refused by relying upon the Hon’ble Supreme Court Judgement in Thalappalam case reported in (2013)16 SCC 82 by stating that RTI Act is not applicable to Co-operative Societies. Both in first appeal and the appeal before the State Information Commission the same stand was reiterated. The Petitioner had to approach Hon’ble High Court even to direct the Commission to pass orders within three months and even had to file Contempt Petition for the delay in passing the orders.
