Madurai: Madras high court on Wednesday observed that it may be necessary to formulate certain guidelines whenever the power of remission or pardon is considered in cases where the crime has an impact on a section of the society or on the whole.


Advocate-general Vijay Narayan submitted that the case of all the convicts was strictly considered in accordance with the GO dated February 1, 2018, by the home (prison IV) department. Three convicts involved in the case were released in 2008 and no law and order issue had arisen despite them being outside for the past 10 years. He further submitted that the secretary of home department followed the GOs in letter and spirit and applied the same for each convict.
A division bench observed that a close reading of the status report shows that the case of the 13 convicts has been released purely based on the GO passed in 2018. They said that the earlier bench had while hearing the criminal appeals filed by the accused people come to a conclusion that the act of the accused persons was not a murder but to terrorize the scheduled caste community who dared to contest in the panchayat election.
