A division bench of Jus tice P Velmurugan and Jus tice M Jothiraman made the observations while dismis sing an appeal moved by a

woman who was sentenced to life imprisonment for abet ting her lover, who raped her minor daughter “The act of A2 (mother) not preventing Al (her paramour) from the commission of the offence but threatening PWI (the mi nor survivor) not to reveal the same to anybody which makes PW1 subjected to sex ual harassment by AL. There fore, the act of A2 clearly comes under the abetment of the offence committed by Al.”

The testimony of the child is found to be reliable. Minor

contradictions or significant discrepancies in the evidence of the child should not be a ground to disbelieve the rella ble prosecution case, the court added.

On Nov 11, 2030, a special court convicted the mother for the offence under section 16 (abetment) and sentenced her to life imprisonment un der the Pocso Act. The ‘para mour’ was convicted for the offence under section 5(1) (ag gravated penetrative sexual assault) and sentenced to life Imprisonment.
