ORDER
(Order of the Court was made by the Hon’ble Chief Justice)
These cases were taken up on the special mention made by learned counsel for the review applicant in Rev.Aplwp.Crl.No.3 of 2026 on the ground that the respondent/State is initiating coercive action against the review applicant and others inspite of the fact that this court had passed an order on 28.4.2026, which reads thus:
“Learned Senior Counsel appearing for contempt petitioner undertakes that the contempt petitioner will not precipitate the contempt proceedings till the next date of hearing.
2. List these matters on 23.06.2026.”
2. Learned Senior Counsel appearing for the contempt petitioner submits that, as per the above order, the contempt petitioner did not precipitate the contempt proceedings till date.
3. The then learned Advocate General had made a submission
on the last date of hearing, i.e., on 28.4.2026, across the bar that the State would also not take any coercive steps till the next date of hearing. Learned counsel on either side agreed for a date to be fixed for hearing. Accordingly, the matter was adjourned to 23.6.2026.
4. Shri Vijay Narayan, learned Advocate General, was present today at the time of hearing and he submitted that an FIR has already been registered. However, copy of the FIR was not produced. He further stated that the State is intending to withdraw Rev.Aplwp.Crl. No.2 of 2026 filed by it. He submitted that he was not aware of the statement made at the Bar by the then Advocate General and only based on the orders passed by this Court, since there was no stay of further proceedings, the State proceeded
further.
5. This factual position is not disputed by any of the learned counsel for the parties present.
6. Be that as it may, since the hearing is already fixed on 23.6.2026, no harm would be caused to the State if further proceedings are kept in abeyance till then.
7. In these circumstances and taking into consideration the statement of the then Advocate General made at the Bar, we direct the State authorities not to undertake any further proceedings against any of the parties till the next date of hearing.
