ORDER
(Order of the Court was made by DR.G.JAYACHANDRAN, J.)
The Review Application in O.S.A.No.17 of 2022 in the matter of
Pachaiyappa’s Trust is taken for consideration today.
2.Apart from the report, which we directed the Court appointed Administrator to file, we have also received an another report dated 02.01.2026.
3.The contention of the report by the Administrator appointed by this Court is very disturbing and apparently the incident is directly against the Administrator appointed by this Court, who is also a former
Judge of this Court.
4.The report indicates that inspite of reporting the incident to the jurisdictional police, so far no action has been taken against the
offenders.
5.The complaint given by the Secretary of the Pachaiyappa’s Trust to the Assistant Commissioner of Police, Kilpauk is also enclosed along with the report. The report of the Administrator about the incident occurred on 23.12.2025 and the complaint to the police even dated are self explanatory. It has been informed across the bar that no action has
been initiated by the jurisdictional police on the complaint.
6.After being aggrieved by the mis-managememnt in the
administration of the Pachaiyappa’s Trust, this Court appointed the former Judge of this Court and presented by Hon’ble Mr.Justice
V.Parthipan, has been appointed as Administrator vide order dated 19.12.2023. Since then, he has taken up the administration of the Trust and is carrying on the management of the Trust. While so, some unruly elements had barged into the college premises and has misbehaved with the Court appointed Administrator. The foul language and the abuse against the Administrator had been hurled by the unruly elements.
7.Unfortunately, even after the matter is brought to the notice of the jurisdictional Police, no action so far, has been taken and we are of the view that the abuse of the unruly elements and inaction by the Police is a direct attack on the Judiciary, as the Administrator appointed by this Court acts on behalf of it.
8.Hence, before proceeding further, we direct the Director General of Police, Commissioner of Police, Chennai, Assistant Commissioner of Police, Kilpauk range to show cause as to why contempt proceedings shall not be initiated against them for their inaction on the complaint
enclosed with the report of the Hon’ble Administrator.
9.The Registry is directed to serve the copy of this order along with the report of the Hon’ble Administrator along with enclosure to the
learned Advocate General and the Public Prosecutor.
10.This Court directs the Officers mentioned above to appear before us in person or through their counsel on 30.01.2026 and file a
report.

ORDER
(Order of the Court was made by K.KUMARESH BABU, J.)
Pursuant to the order of this Court dated 25.07.2025, the Hon’ble Administrator had filed a report inter alia enlisting the concern of the Trust. For better appreciation, the relevant paragraph is extracted
hereunder:-
“21.THE CHALLENGES WHICH ARE
PENDING CONCERNING THE PACHAIYAPPA’S
TRUST
a. The modification of Scheme for Clauses 11(J) & 11(B) 2,3,4,5 in C.S.No.223 of 2022 is pending before the Scheme court of this Hon’ble Court for adjudication and for the interest of better Administration.
b. The cases are pending before the Hon’ble Supreme Court of India in SLP (C) No.23539 of 2023 against common judgement dated 28.04.2023 in
O.S.A.Nos.17,81,128 and 222 of 2023.
c. 234 Assistant Professors/Teaching Faculties were illegally appointed by the Erstwhile Trust Board during their period from 2013 to 2016 and same were set aside by this Hon’ble Court vide order dated 17.11.2022 in W.P. No. 19939 of 2014 and W.P.No.36827 of 2016.
Further issued direction to the
Administrator/Management of Pachaiyappa’s Trust to fill up all posts as per the UGC Regulations as well as provisions of Tamil Nadu Private Colleges (Regulations) Act 1976, but against which, batch of Writ Appeals in
W.A.No.2558 of 2022 and etc., have been filed before the Hon’ble Division Bench, which are pending.
d. As per the direction of the Hon’ble Division Bench of this Hon’ble Court dated 28.04.2023 made in O.S.A.Nos. 17, 81, 128 & 222 of 2022, paper publication issued on various dates viz., 23.05.2023, 13.09.2023 & 24.01.2024 with regard to enrollment of voters from various categories and received representations/suggestions from them which are pending under consideration. The election process is to be taken after smooth functioning of the Trust Affairs.
e. Audit of accounts for the financial years 2013-2014 to 2022-2023 were audited by new Auditor, viz., M/s. Ramesh Subramaniam & Co., who has been appointed by the Scheme Court vide order dated 18.06.2025 in Application No. 2643 of 2025. In the Audit it was found that no proper audit was done and also failed to file proper returns for periods with regard to Estate of Chellammal Trust from 2013-2014 to 2017-2018 as well as Pachaiyappa’s Estate and also there was misappropriation of funds of college and Trusts from 2022 – 2023. Action has been taken in this regard and pending.”

We take note of the pending suit in C.S.No.223 of 2022 before this Court where a prayer for modification of clause 11(J) & 11(B) of the Scheme has been made and also the Special Leave Petition in S.L.P. (C).No.23539 of 2023. The said Special Leave Petition had been filed against the judgment and decree in O.S.A.No.128 of 2022, in respect of the order made in Application No.1749 of 2019. The Application No.1749 of 2019, is an application challenging the lease deeds executed by the Pachaiyappa’s Trust Board in favour of one private individual. The pendency of the said Special Leave Petition cannot have any bearing on the directions issued by this Court for conducting the elections. The Special Leave Petition challenging the judgment and decree made in the Original Side Application with regard to the Scheme that was modified by this Court therein have been affirmed by the Hon’ble Apex Court, in
the Special Leave Petition filed against such order.
3. The Hon’ble Administrator had indicated that pursuant to the
paper publications issued pursuant to the directions issued in the Original Side Appeals, various representations/ suggestions have been received
and are pending for consideration.
4. In such view of the matter, we are of the considered view that if
such representations and suggestions received pursuant to the publications made by the Hon’ble Administrator with regard to the
holding of elections after updating the Voters list in respect of various Constituencies are placed before this Court by way of a further report, it would also throw a light as to the elections to be conducted even pending
the trial in C.S.No.223 of 2022.
5. We therefore request the Hon’ble Administrator to list out the representations and suggestions received in that regard and also offer his views on the same qua the bye-laws of Trust. Such report shall be placed
before this Court on 03.03.2026.
