What could happen during #JanaNayagan hearing before the Chief Justice’s Bench of #MadrasHighCourt on Jan 20…
Possibility 1: Producers may agree for revising committee reference & request the court to fix a time limit for the decision of the committee. (The threat in this possibility is that the CBFC Chairman can still differ with the recommendations of the first revising committee & choose to constitute a second revising committee thereby delaying the certification process.)
Possibility 2: If the producers choose not to agree for the revising committee and instead prefer to argue the writ appeal, the Chief Justice’s Bench may allow the appeal and set aside the single judge’s order. (If such an order is passed by the Division Bench, the producers can take it on appeal to the Supreme Court)
Possibility 3: Chief Justice’s Bench may dispose of the appeal by remanding the matter back to the single judge for rehearing after granting time to the CBFC to file a counter affidavit. (The problem in this possibility is that the entire hearing will have to begin from the scratch and it may take several months for the movie to release since the single judge’s order can once again be appealed before the Division Bench & then the Supreme Court.)
Possibility 4 (a very remote possibility): The Chief Justice’s Bench may dismiss the writ appeal and uphold the single judge’s order directing CBFC to issue U/A 16+ certificate. (The problem in this possibility is that the CBFC can take the Division Bench’s order on appeal to the Supreme Court.)
I REPEAT WHAT I HAD SAID IN THE PAST: Litigation is a time consuming process. If parties want a quick solution, it is better to resolve disputes among themselves.
