This Court by order dated 23.06.2021, based on the allegations made by the petitioner, directed the District Educational Officer/3rd respondent to conduct an enquriy into the allegations made by the petitioner and submit a report. Further, the Chief Educational Officer was also directed to send suitable instructions to all the Government schools that they should not collect any excess amount from the students and they should strictly adhere to the proceedings dated 18.06.2021.

Following the aforesaid directions of this Court, the 3rd respondent/District Educational Officer has filed a counter affidavit before this Court, wherein it is stated that pursuant to the order passed by this Court, the Headmistress/4th respondent has submitted her explanation stating that only based on resolution dated 14.06.2021 passed by the Parents Teachers Association, she has collected the amount of Rs.50 for standard 6th to 10th and Rs.100 for standard 11th & 12th (Rs.50 for PTA Subscription and another Rs.50 for school maintenance) from 241 students and remitted the said amount to the Government account. She has stated that she has not retained any money collected from the students.

On verification, it is found that none of the office bearers of Parents Teachers Association have signed in the resolution dated 14.06.2021 and only teachers and Headmistress have signed in the said resolution.

Pursuant to the order of this Court dated 23.06.2021, the 2nd respondent/Commissioner of School Education, Chennai-6 has also sent a communication in Na.Ka.No. 29345/W1/E2/2021, dated 13.07.2021 to all the Chief Education Officers, directing to issue a suitable instructions to all the Head master/headmistress of the schools. The relevant portion is extracted below;

In view of the aforesaid communication, the Commissioner of School Education has complied with the directions issued by this Court.

From the statement made by the 3rd respondent/District Educational Officer in the counter affidavit, the 4th respondent/Headmistress has collected excess amount without adhering the proceedings issued by the Chief Education Officer. The said act of the Headmistress has to be viewed seriously. Hence the 3rd respondent/District Educational Officer is directed to file action taken report against the 4th respondent/Headmistress.

Therefore, to take further course of action in this matter, the following directions are issued;

i. The circular issued by the Commissioner of School Education dated 13.07.2021 shall be displayed in the notice boards of all the Government Schools.

ii. As per the aforesaid circular issued by the Commissioner of School Education, all the Chief Educational Officers and the District Educational Officers shall conduct periodical inspection in the Government Schools of their jurisdiction on their own or based on the complaints if any, alleging collection of excess amount from the students and submit a report to the Commissioner of School Education, Chennai.

iii. The Commissioner of School Education, Chennai is further directed to collect a district wise report from the Chief Educational Officers concerned and submit a report before this Court on 27.07.2021.

Post the writ petition on 27.07.2021.
