நெல்லையப்பர் கோவிலில் அனுமதிக்கப்பட்ட கடைகள் தொடர்பாக HRCE துறையை கண்டித்த உயர்நீதிமன்றம் – இணை ஆணையருக்கு நேரில் வருமாறு உத்தரவு

25.06.2025 அன்று, மாண்புமிகு நீதியரசர் S.M. சுப்ரமணியம் மற்றும் நீதியரசர் அருள்முருகன் ஆகியோர் அடங்கிய அமர்வில் மதுரை கிளை உயர் நீதிமன்றத்தின் முதல் பெஞ்ச், நெல்லையப்பர் சுவாமி கோவிலின் புனித மண்டபத்தில் அமைக்கப்பட்டுள்ள வர்த்தக கடைகளுக்கு எதிரான ஒரு பொது நல வழக்கின் மனுவில், HRCE துறையின் செயல்பாடுகளை கடுமையாக விமர்சித்தது.

இந்த பொது நல மனுவை திரு. பாலசுப்பிரமணியன் தாக்கல் செய்திருந்தார். இதில், கோவிலின் புராதான மண்டபத்தின் பகுதிகளில் சில ஆபத்தான வர்த்தக கடைகள் செயல்படுவதை HRCE துறை அனுமதித்து வருவதாகவும், அவை பெரும் பாதுகாப்பு அச்சுறுத்தலையும் ஆன்மீக அவமதிப்பையும் ஏற்படுத்துகின்றன எனவும் புகார் செய்யப்பட்டது.மனுதாரரின் சார்பில் திரு. வாதிராஜ் அநிருத் அவர்கள் ஆஜராக, மாநில அரசு மற்றும் HRCE துறையை சார்பாக அரசு வழக்குரைஞர் ஆஜராகினார்.

மேலும், இந்த கோவில், சுயமோட்டு W.P. No. 574/2015 வழக்கின் அடிப்படையில் பாரம்பரிய நினைவுச் சின்னமாக அறிவிக்கப்பட வேண்டியதாக நீதிமன்றம் ஏற்கனவே கூறியுள்ளதை மனுதாரர் குறிப்பிடினார்.

இந்த விவகாரத்தில் நீதிபதிகள் கடும் அதிருப்தி தெரிவித்து, திருநெல்வேலி இணை ஆணையருக்கு, 2025 ஜூன் 26-ம் தேதி காலை 10:30 மணிக்கு நீதிமன்றத்தில் நேரில் ஆஜராகி விளக்கம் அளிக்க உத்தரவிட்டனர்.

In a significant development, the Hon’ble First Bench of the Madurai Bench of the Madras High Court comprising of Justice SM Subramaniam and Justice arul murugan has come down heavily on the Hindu Religious and Charitable Endowments (HRCE) Department in connection with a Public Interest Litigation (PIL) filed by Shri Balasubramanyan.

The PIL pertains to the declaration of the historic Nellaiappar Swamy Temple as a protected monument, as per directions issued in Suo Motu W.P. No. 574 of 2015. The petitioner raised serious concerns about the HRCE’s alleged negligence in allowing hazardous commercial shops to operate within the sacred mandapam of the temple premises—an act the petitioner contends desecrates the sanctity of the site and poses safety risks.

Taking strong exception to the matter, the Hon’ble Judges expressed their displeasure and issued summons to the Joint Commissioner, Tirunelveli, directing personal appearance before the Court at 10:30 AM to provide an explanation.

Shri Vadiraj Anirudh appeared on behalf of the petitioner, while the Government Pleader represented the State and the HRCE Department.
