AFFIDAVIT OF AADHAV ARJUNA
I, Aadhav Arjuna, Son of Rajendran, aged about 42, residing at 41, Kasthuri Rangan Road, Poes Garden, Alwarpet, Chennai – 18, do hereby sincerely and solemnly affirm as follows;
1. I am the Petitioner. I am well acquainted with the facts and circumstances of the case. I am filing this writ petition in the nature of a Public Interest Litigation. My PAN No is BJSPA9537Q. My AADHAR No.is 7260 7857 7012. The Public Interest Litigation is not motivated or filed for a personal gain. The litigation is exclusively funded by me. I have not filed any other similar Petition or case for the same cause of action. I have individually borne all the expenses, including the legal fees for filing the above Writ Petition.
2. I am filing this writ petition seeking for the issuance of a writ in the nature of a WRIT OF MANDAMUS or any other appropriate writ, order or direction, directing the 2nd Respondent to Transfer the Investigation relating to death of innocent public during the meeting held at Karur by Tamizhaga Vettri Kazhagam (TVK) conducted on 27.09.2025 to the 7th respondent, Central Bureau of Investigation for a fair probe based on the representation dated and for consequential orders.
3. Having been a Political Science Student myself and in active Politics for more than 30 years, I joined Tamizhaga Vettri Kazhagam as General Secretary of Election Campaign Management. My active involvement in politics is not merely aligned with ensuring the success of my Political Party but also with the mission of upholding the principles of Social Justice, Anti-Corruption and the protection of Dalit rights and marginalized communities. It is for this purpose I have been striving hard along with the Political Party I am affiliated with.
4. From the inception the Government of Tamil Nadu is creating spokes in the functioning of the Political parties adverse to them. It is a difficult task to secure the permission to hold the meetings or rallies. Even earlier we have moved the Court for securing a fair treatment from the Police, which is operating directly under the Chief Minister of Tamil Nadu and the President of DMK party. The police had been acting in a partisan manner and has been harassing the organizers.
5. Our leader Mr. Vijay has been enduring the taunts in the larger interest of the public and has been waiting patiently hoping good sense will prevail upon the administration. This does not appear to be. The officials are dancing to the tunes of their political masters. The political masters do not know the difference between their political party and their duty to the job they have undertaken in administrating the State as the trustee of the people. The latter, they are expected to be fair and even.
6. I state that deliberately permission will not be granted in the place requested by us. It is not only for my party, but also for the other recognized political party. At the same time, the DMK party will have all the permission and blessings from the police administration and Revenue authority. The police have in fact threatened the organizers of the political parties, barring the DMK and its allies, from exercising the their Constitutional rights.
7. In fact, we have more gathering and are keen in ensuring that the cadres as well as the public are safe. The police have taken yeomen steps to thwart it. They have granted permission in areas that would
not accommodate even a decent crowd. This happened in Namakkal, Tiruchirapalli and Nagapattinam. As the Cadres and the public are law abiding, they governed themselves decently without any breach to the conditions imposed.
8. However, during the public gathering held on 27.09.2025, at Karur Conducted by my Political Party, Tamizhaga Vetri Kazhagam (TVK) an unfortunate incident had been engineered by the police and the local politician with the illicit connection with the local goondas. Even before the starting of the speech, the electricity line was disconnected because of which the goondas and general public started to jam together and generator was used for electricity. Total speech of our Leader was about 10 minutes, during the speech, some anti social elements who infiltrated our rally, threw slippers and stones not only on our leader, but also on the public awaiting to witness and hear the speech of our leader.
9. I humbly submit that as the permission was sought for about 3 PM to 10 PM and the crowd started gathering there, the police who were in the vicinity never cared about controlling the crowd by providing more force. As the site provided by the police department, is narrow with no wind circulation and stone hurled by anti social elements while the ambulance was moving through the crowd, the stampede stared and the crowd started suffocating leading to the unfortunate incident. The Government officers who became the puppet of the ruling party, disconnected the electricity and failed to manage the crowd despite having seen such a huge crowd. It is pertinent to note that the anti – social elements started the riot because our leader was out spoken about illegal sand mining, TASMAC Liquor corruption, Transport and other corruptions by the ruling parties and that too happening in Karur district. It is pertinent to note that
even in the campaign at Nagapattinam, electricity was
disconnected. It is obvious that already the separated of powers of Government Machinery was already compromised in the illegal sand mining issue and TASMAC Liquor issue leading to authoritarian Government in Karur district. Being so, challenging the same resulted rioting by anti-social element who infiltrered within the party cadres. It is a warning for all who speak against illegal sand mining and TASMAC Liquor issue.
10. I humbly submit that the repeated pattern of disconnection of electricity and allotting much confined spaces by Government officials for rally shows that the ruling party is determined to stop
our rally at any cost. Being so, permitting the persons who fixed the spot for rally, to find out the cause of untoward incident in such rally, is certainly conflict of interest. Since there is a repeated pattern of disconnection of electricity, it is evident that the intent of sabatoging our rally lies in the higher ups of the State Government Machinery. As such, unless CBI, takes up this case, there is no possibility to bring the truth to the light and Justice to the innocent.
11. The police and the goondas allowed the vehicles to run through the crowd, presumably in the form of Ambulance. They were empty with no patients. Even before the crowd could pave way to the ambulances, multiple in number moving at regular intervals, the police swung into action and started lathi charging the standing innocent public. There is no reason for the police to wield their
lathis.
12. I am shudder to appreciate as to what prompted the police to use the lathi as against the common man, innocent ladies and village folks and the cadres. I am also producing the video recorded by a press man. Needless to add, some of the Press are purchased and ensured that the real situation are not witnessed by the world and showed the Local MLA found in the spot in less than 5 minutes with the press and the Hospital getting geared for accomodating the patients. It is no humour to say, the hospitals were gotten ready even before the incident occurred. It is also pertinent to note that I along with party cadres were beaten and not allowed to enter the hospital to check on the victims of this cowardly act caused by the Acting government. This gives a strong suspicion whether the entire work is engineered by the local politicians. Whatever it is, it is not good for the community and particularly to the families who have come to hear the leader.
13. During the mellie incited by the police, some have sustained grievous injuries and a few lost their lives. The tragic incident occurred between 6.30 p.m. and 8.00 p.m. in Velusamypuram, Karur District. As the General Secretary of the Election Campaigning Wing, I accompanied the Leader during the rally. I have witnessed the events that had taken place and is much
competent to file the affidavit to bring to the notice of the Court that all is not well with the State administration and the police force is acting as a slave of the ruling party.
14. It is submitted that the Tamizhaga Vetri Kazhagam has been conducting rallies across the state in view of the upcoming elections. Prior to each rally, appropriate permissions are sought from the respective District Secretaries, Revenue Officials and from Police Officials for the purpose of conducting rallies and Public Gatherings. In the present scenario where an unfortunate incident of stampede, had taken place, Permissions were sought from the Police and Government officials in consonance with due process of law. However, the place suggested by the Police and Government Officials were not to our satisfactory and alternate place was requested for effective public gathering and conveniences.
15. The Police and other Government official despite knowing the fact that there will be huge public gathering to witness their political leader have rejected the permission sought for the different place. This is nothing but a targeted action. There is no doubt there are positive responses for our Leader across the State wherever he addresses. The present Government being unable to tolerate or consume the overwhelming encouragement that is received for the Leader of Tamizhaga Vetri Kazhagam has adopted to a devious ploy of placing constant hindrances and obstacles not only to his Public Gatherings but also on the entire Party ever since its inception.
16. It is pertinent to note our political leader in an earlier occasion and
also in the present public gathering has addressed the inconveniences that is placed on the Political Party in according sanctions in appropriate place. The video footage is attached along the Petition and the same may be read as part and parcel of this affidavit. Our leader has explicitly mentioned that the Government is arbitrarily rejecting and not according to the rule of law. While Mr. Udayanidhi were given spot namely Karur Kovai road, they decline to grant permission in the very same area despite our assurance that we will not block the road and ensure that the public will organize themselves in a manner that the free flow of the traffic is not hindered.
17. The police the earlier part of the week declined to grant permission to the AIADMK party which sought permission for Eddapadi
Palanisamy. The crowd has to assemble in Velusamipuram. Much inconvenience was caused to the public. The very same area was chosen for my party. We had shown the crowd that assembled at Tiruchirapalli, Namakkal and Nagapattinam and said this place earmarked at Karur is hardly sufficient. As per the dictation of the police and the plae identified by them, we were called upon to give a letter as dictated by them. Otherwise, they said they will not grant any permission. This was at the verge of holding the meeting. We had no option left nor we could have moved the court for this purpose.
18. The ruling dispensation has taken an agenda to tarnish the reputation of our political party. It is common to have political rivalry but it cannot be tolerated when its costs the lives of innocent citizens. Only cowards fight meanly and I feel little even to bring to the notice of the Court the manner in which political scores are sought to be settled by the DMK party and its hooligans. Unfortunately, they are using the Police and Revenue Administration as a tool and willingly they have let themselves manipulated.
19. We have evolved as a political party and capable of upsetting the aspiration of the DMK. Mr. V. Senthil Balaji the “eminent face” of the Acting Government has planned the entire event and I am advised to take appropriate legal action against him as soon as the probe is complete by an unbiased agency. Presently, I am aggrieved by the continuation of the probe by the local police or the police force working under DMK government.
20. It is submitted that the opposition party namely the ADMK had faced lot of commotions and chaos in the same location during their political gathering. However, the crowd that was gathered for the opposition party was much lesser when compared to the Crowd that was gathered to the Tamizhaga Vetri Kazhagam (TVK). The factum in relation to obstacles and hindrances that are placed in present location for conducting a Public Gathering (For which sanction has been issued) is well known to Acting DMK Government and the permission was granted despite sufficient resistance from our end. 21. Furthermore, it had come to had knowledge that the Hon’ble Deputy Chief Minister of the State had recently conducted a rally in Karur at the “Karur-Kovai Janatha Theatre,” where a large crowd has been gathered and the event was managed without any difficulty. However, for reasons best known of the Government officials, permission for the said location was denied, and we were forced to seek for permission in a different location namely “Light House Roundana” It is pertinent to note that many Political leaders including former Chief Ministers of Tamil Nadu had conducted meeting in the “Light House Roundana” and said place could handle the large crowd. The District Officials, intentionaly refused to accord permission in the said place, instead, we were compelled to conduct the rally at the venue where the unfortunate stampede had occurred. Upon verification, we found that the location insisted upon by the government official was a narrow road, unsuitable for political rallies, especially when a huge crowd is gathered. Looking
at it from any angle it came be strongly contended that the stampede is a political rivalry conspired by the ruling Government using the Government officials and Police machinery has a tool to ensure the reputation of our Political Party is tarnished and damaged. Unfortunately, the Government has succeeded in the motivated actions, but the result and the strategy adopted for the same is highly condemnable and deeply regrettable.
22. It has become a common practice for the Political rivalry namely the Acting DMK Government to Harras or cause inconvenience to our leader. In the earlier occasions ambulance were driven to disrupt the gathering, electricity connections were turned off and inadequate police protection was ordered to ensure there is disharmony. Fortunately, the rival political party had failed in the earlier attempts in causing disruptions to the gathering. There is no doubt they were waiting for the right time and place. These facts were also explicitly pointed out by our political leader during his speeches. In karur, it is not only disconnection of electricity and running vehiles inside the crowd, but adding a further theme of lathi charge on the public.
23. Similarly in the present gathering, during the speech of our political leader when allegations were made against the former Minister Senthil Balaji, the electricity connections were turned off and slippers and stones were thrown inside the crowd. Taking advantage of the situation, the Police officials has conducted lathi charges barbarously in the crowd in a haphazard manner. This deliberate and conscious strategy adopted by the political rivalry is the proximate reason for disruption in the crowd eventually leading to falling of one on the another. The Police officials are aware of as to who those unscrupulous elements are. Their acting as henchmen to the Acting Government and hand in glove with other personals to conduct a strategic, commotions. The Political rivalry namely the Acting Government had succeded in their premeditated plan of throwing abuse on our political leader.
24. It is submitted that these events are planned and executed by the Acting Government to use the same as a false narrative to spread hatred against our Political Party. The Acting Government is already trying to take undue advantage over the situation and create, propagate, publish misinformation with malafide intentions for defaming the party and its image before the General Public owning to the fact that it had gained positive responses in the recent. Irrespective of the same, an unfair, and unbiased investigation would throw various facts to light which shall bring the true culprits before the eyes of law.
25. The present litigation is absolutely warranted and it is prayed that this Hon’ble Court closely monitors the situation as done in several occasions in the interest of Justice. The litigation cannot be viewed as frivolous or a mode adopted to protect the interest of the Political party. It is humbly submitted that the litigation is the direct consequence of the conspiracy adopted by the Acting Government and to ensure the culprits are made to stand before the Court of law. It is further submitted that the conspirers and criminals involved in the direct cause for disruption and instigating the sentiments of public cannot be left Scot free.
26. It has been brought to our knowledge that the Acting Government has formed a committee under the presidency of Aruna Jagadeesan, former High Court Judge to enquire into the reasons for stampede and all other incidental and connected offences. The Committee is a mere eye wash and cannot be believed to bring true facts to light. On several occasions, the DMK government has adopted to such strategy to protect their image before the General Public but there shall be no progress or result in pursuance of formation of such committees. The committee under the head of the Former High Court Judge shall not be sufficient to bring true facts to light or overcome the political dominance that is involved in the present issue.
27. The Political Party TVK has a strong responsibility in ensuring that justice is served in this issue. It is highly condemnable that the Acting Government despite being actively involved in the conspiracy is performing a stage show Infront of the public as if they are more concerned about the lives of the public. The conduct of the Government is well known from the past incidents like Hooch Tragedy, its closely affiliated members getting arrested under drug busts, and even its ministers getting arrested for scams on frequent basis. It is high time, that the Acting Government is removed from its position. All the members involved in the party visits prison like their home. Particularly, Mr. Senthil Balaji who had served as a under trial prisoner for a very long time was appointed as a minister immediately after he was released on bail. The Acting Government bearing such conducts is highly untrustworthy and is capable to going to any extent to hide their conspiracy and suppress material facts before the Committee appointed by them or by exercising their highhandedness in the Police Machinery.
28. The Political party in the interest of public firmly submits that it does not have any belief in the State Investigating Agencies. There are numerous reasons as stated in the earlier paragraphs to suspect the active involvement of the Acting Government and agencies in causing the stampede. The Tamilzhaga Vetri kazhagam is also ready to cooperate for any investigation in this regard by the officials of 7th Respondent. The Political party has also filed a police complaint before the state machinery on which no action was taken and the same exhibits their unwillingness to adhere to the voice of the Political party raised in the interest of justice and in the interest of public. If at all the investigation is not transferred to the 7th Respondent there are ample chances of truth getting, suppressed, evidences being tampered and false allegations being raised not only against the political party but also against the innocent citizens.
29. It is also pertinent to note that immediately after the tragedy, the former Minister, Mr. Senthil Balaji, arrived at the hospital within a few minutes to witness the victims. Similarly, the Hon’ble Minister for School Education also reached Karur without delay. The swiftness of their presence at the hospital raises a strong inference that the authorities were anticipating such an incident, as they appeared at the hospital almost simultaneously with the arrival of the victims who were brought dead. When our Hon’ble Chief Minister refused to see the victims of the Kallakurichi hooch tragedy which resulted around 70 deads, he had immediately appeared in the Karur. In fact, postmortem was done in midnight for all the dead and they were ready for burial and everything was arranged before the Hon’ble Chief Minister came to the Hospital.
30. I am hard put to appreciate as to how all the doctors were made available in the hospital. The conduct of the post mortem contrary to the rules, viz., after the sun set and before the sun rise. Embalming the body and keeping it ready for Mr. Stalin, the Chief minister to place the wreath by 1.30 to 2 AM. I suspect this stampede was done by persons interested in suppressing the truth and they have stoop down to act. All the CCTV in the area should be ceized and secured safetly.
31. It is further submitted that Tamizhaga Vetri Kazhagam is only a upcoming Political Party whose growth and raise is being unnecessarily curtailed by Acting DMK government whose leader’s family constantly engage in corruptions. There are sufficient reasons to believe that the State government will give instructions to the state investigating agency to twist the fact and propagate false narratives, direct targeted actions to fulfill their vengeance. It is also for this reason; it is absolutely necessary that a uncompromised or unbiased investigating agencies who cannot be influenced by the DMK party or even the TVK party for that matter to investigate in relation to the stampede and offence committed in relation thereto. Our political party has an implied to duty to place all these facts before this Hon’ble Forum to ensure that an unbiased investigation is commenced in the interest of justice. Hence the Present writ petition is filed among the following
GROUNDS
A. That the Political Party represented by the Peittioner was not accorded with sanction to an appropriate place and was arbitrarily placed under a compulsion to conduct public gatherings in place where there is inconvenience.
B. That permitting the perpetrator of crime to investigate the
offence is conflict of interest.
C. That the Acting Government has initiated a targeted action against the Political party with the intention of wreaking vengeance and cannot be allowed to suppress material facts and provide mis informations.
D. That it is absolutely necessary that an unbiased and un infleunces machinery conducts the investigation in relation to the stampede and offences committed in relation to the same.
E. That the Acting Government has conspired by providing less security personnnels and according sanctions to places where there are lot of inconveniences for public gatherings and addressing
F. That the Acting Government has miserably failed in its duty and has stooped down to the level of creating events that can costs the lives of innocent public inorder to seek vengeance against the Political party of the Petitioner.
32. For the reasons stated above, it is therefore prayed that this Hon’ble Court may be pleased to issue an AD-INTERIM
DIRECTION to the Investigating Officer to secure the CCTV footage in and around the location were meeting was held at Karur by Tamizhaga Vettri Kazhagam (TVK) conducted on 27.09.2025 and produce the same before this Hon’ble Court, pending disposal of the writ petition and thereby render justice.
33. For the reasons stated hereinabove, it is most humbly prayed that this Hon’ble Court may be pleased to grant an AD-INTERIM INJUNCTION, restraining the 5th and 6th Respondents, their men, subordinates, agents, or any person claiming under or through them, from in any manner obstructing or preventing the Petitioner and Mr. Vijay, Leader of Tamizhaga Vettri Kazhagam (TVK) and myself from visiting the victims of the stampede during the meeting held by Tamizhaga Vettri Kazhagam (TVK) on 27.09.2025 in Karur District and their family members in Karur District, pending disposal of the present writ petition, and thus render justice.
34. For the reasons stated in the foregoing affidavit, it is therefore prayed that this Hon’ble Court may be pleased to issue a WRIT OF MANDAMUS or any other appropriate writ, order or direction, directing the 2nd Respondent to Transfer the Investigation relating to death of innocent public during the meeting held by Tamizhaga Vettri Kazhagam (TVK) conducted on 27.09.2025 to the 7th respondent, Central Bureau of Investigation for a fair probe based on the representation of the dated and thereby render justice.

For the reasons stated hereinabove, it is most humbly prayed that this Hon’ble Court may be pleased to grant an AD-INTERIM INJUNCTION, restraining the 5th and 6th Respondents, their men, subordinates, agents, or any person claiming under or through them, from in any manner obstructing or preventing the Petitioner and Mr. Vijay, Leader of Tamizhaga Vettri Kazhagam (TVK), from visiting the victims of the stampede during the meeting held Karur by Tamizhaga Vettri Kazhagam (TVK) on 27.09.2025 in Karur District and their family members in Karur District, pending disposal of the present writ petition, and thus render justice.
