In his submission he touched upon various provisions of the HR&CE Act, 1959 which empowers the Commissioner to interfere in Affairs of the Religious Institutions, Agamas and Rituals of the Temple. Those sections are against the Preamble and Arts. 25 and 26 of the Constitution of India which need to be read down to bring into the line with the demand of the Constitution and various judicial pronouncements of the Hon’ble Apex Court.
