I submit that the petitioners who are members of Rashtriya Swayamsevak Sangh [RSS] had announced to conduct a route march followed by Public meeting in 50 districts for State of Tamil Nadu on 02.10.2022. I further submit that the route march was allegedly to celebrate the 75th year of Independence and birth centenary of Dr.B.R.

Ambedkar.

  1. I submit that the petitioners had given representations to all the Station House Officers of various Police Stations. I further submit that when the representations were under considerations the above petitioners filed a Writ Petitions before this Hon’ble High Court, all the Writ Petitions were clubbed together and was heard on 22.09.2022. The

Hon’ble High Court was pleased to pass an order to direct the Police Department to grant permission to conduct the procession followed by Public Meeting on 02.10.2022 throughout the State of Tamil Nadu on or before 28.09.2022.

3.I submit that during this interregnum the Union Government through its agency National Investigation Agency (NIA) conducted several raids throughout India against the ‘Popular Front of India’ and other allied organizations followed by that ‘Popular Front of India’ [PFI] and other similar organizations were banned for a period of 5 years on 28.09.2022. I further submit that PFI and various other allied organizations had protested this ban and also there were attacks owning to this ban across

India especially on functionaries of petitioner’s organizations and other allied organizations and political parties.

  1. I submit that due to the ban of Popular Front of India [PFI], there is threat from various sources to the Leaders of the Petitioners Organization till date. Under those, circumstances, it was assessed that the prevailing conditions it is not safe to conduct procession by the Petitioners Organization. In such a circumstance it was decided that due to prevailing Law and Order situations and ban of Popular Front of India [PFI] the permission seeking Procession followed by the Public Meeting was rejected.
  2. I submit that the petitioners who very well knew about the ban of Popular Front of India [PFI] went ahead and filed a Contempt Petitions to grant permission for the procession followed by Public Meeting, as per the orders in W.P.No.25213 of 2022.
  3. I submit that when the Contempt Petitions were taken up for hearing on 30.09.2022 the counsel for the petitioners and the State was heard and the prevailing situations about the ban of Popular Front of India [PFI] and other similar various organizations for the period of 5 years by the Union Government was pointed out and the threats faced by the leaders of Petitioners organization was also informed to the Court.
  4. I submit that it was also pointed out to the court that due to the ban of the above mentioned organizations, there were 59144 Police Personnel were posted under the supervision of Deputy Superintendents of Police to various Political Leaders of Petitioner’s organization and it is allied Political Parties. I further submit that it was pointed out to this

Hon’ble High Court that if the procession is conducted on 02.10.2022 it will be a risk to their life and limb as well as disrupt the law and order in the state.

  1. I submit that during the course of arguments in Contempt Petitions the counsel on behalf of the petitioners accepting the arguments of the State had suggested four dates for conducting procession followed by Public Meeting. I further submit that on the submission made by the both sides, the Court fixed the date to conduct Public Meeting on 06.11.2022 and further directed the petitioners not to precipitate the issue further.
  2. I submit that when the matter was listed on 31.10.2022 the Director General of Police had produced the order dated 29.10.2022 which authorized respective Commissioner of Police / Superintendent of Police to consider the representations of the Petitioners to conduct procession followed by Public meeting by assessing the Law and Order situations prevailing in their jurisdiction.
  3. I submit that as per the orders of the Director General of Police dated 29.10.2022 the respective Commissioner of Police / Superintendent of Police out of 50 places, 23 places/districts the petitioners were permitted to conduct the procession followed by Public Meeting in an indoor place specifically mentioning the security reasons. I further submitted that so far as 24 places are concerned authorities found that there will be a Law and Order problem and rejected it again in view of the intelligence report from both the State agency and the Union Government.

I submit that after going through the Intelligence report the Court had observed that ongoing Law and Order situation and the recent incidents relating to Car Blast on 23.10.2022 in Coimbatore which is being investigated by the NIA it had upheld the rejection of procession followed by Public Meeting on 06.11.2022 in the following Districts alone.

  1. I submit that after considering the Intelligence report, prevailing the Law and Order situations and the submission of counsel on either side the court was pleased to grant permission to conduct procession in all locations except for the above mentioned 6 places, with certain reasonable restriction which are in no way violative of the rights of the petitioner.
  2. I submit that the petitioner’s organizations after the order in its officials press release had declared that the procession will not be conducted on 06.11.2022 for the reasons best known.
  3. I submit that now, the petitioners have come forward with the Letters Patent Appeal to set aside the Order and consequently punish the respondents which is prima facie not maintainable.

  1. I submit that this Hon’ble Court in the Contempt Petitions had concluded that there is no willful disobedience on the part of the respondents and dismissed the contempt petitions. I further submit that once the contempt Petitions is filed the matter is between the court and the contemnor and the petitioners have no say whether the court has to decide whether its order was willfully disobeyed and whether punishment is necessary.
  2. I submit that permission was granted for 23 places to conduct procession followed by the Public Meeting in an indoor place, and orders were passed stating sufficient reasons that prevailing situations is not conducive for the petitioner’s organizations. I am advised to submit that while deciding the question of Law and Order the Supreme Court in this judgment reported in Karnataka Live Band Restaurants Association Vs. State of Karnataka and Others reported in (2018) 4 SCC 372

Lex” which means safety of the State is the supreme law.

In our considered view, it is the prime duty, rather statutory duty, of the Police personal/administration of every State to maintain and give precedence to the safety and the morality of the people and the State….”.

I further submit that various decisions of the Supreme Court starting from Hitmat Lal K.Shah Vs Commissioner of Police, Ahmedabad and another reported in 1973 (1) SCC 227 to Ramilah Maithan incident  reported    in   2012   (5)   SCC  1  has  held that  a  regularity

mechanism of reasonable restrictions contemplated under Articles 19(2) & 19(3) of Constitution of India can be imposed by the authorities which will help in insuring due Social order and also would not impinge upon rights of the others contemplated under Article 21 that Constitution of India.I further submit that the Police Authorities who are required to maintain   the Social orders and Public tranquility have a say in the organizational matters relating to holding of dharnas, procession, agitation and rally’ s of the present kind.

 

  1. I submit that the LPA’s filed challenging order for the contempt is not maintainable on 2 grounds
  • When the contempt is dismissed and the court had found that there is no willful disobedience against the dismissal of the contempt petition, the contempt appeal by the petitioners will not lie. The petitioners by filing a Letters patent appeal is trying to achieve indirectly what cannot be done directly.
  • Although the order passed by the Single Judge of the Hon’ble High Court dismissing the contempt petition is a final order, a part of the order which issues directions and reasonable restrictions in conducting the procession followed by a public meeting is interlocutory in nature and it does not affect the right of the petitioners forever.

 

  1. I am advised to submit that in the decision by the Supreme Court reported in Madhu Limaye v. State of Maharashtra, (1977) 4 SCC 551 : 1978 SCC (Cri) 10 at page 557 it was held that

“12. Ordinarily and generally the expression “interlocutory order” has been understood and taken to mean as a converse of the term “final order”. In volume 22 of the third edition of Halsbury’s Laws of England at p. 742, however, it has been stated in para 1606:

“… a judgment or order may be final for one purpose and interlocutory for another, or final as to part and interlocutory as to part. The meaning of the two words must therefore be considered separately in relation to the particular purpose for which it is required.”

In para 1607 it is said:

“In general a judgment or order which determines the principal matter in question is termed ‘final’.”

In para 1608 at pp. 744 and 745 we find the words:

“An order which does not deal with the final rights of the parties, but either (1) is made before judgment, and gives no final decision on the matters in dispute, but is merely on a matter of procedure, or (2) is made after judgment, and merely directs how the declaration of right already given in the final judgment, are to be worked out, is termed ‘interlocutory’. An interlocutory order, though not conclusive of the main dispute, may be conclusive as to the subordinate matter with which it deals.”

This judgment makes it clear that a judgment or an order may be final for one purpose and interlocutory for another or final as to part and interlocutory as to particle. It is further submitted that in the case in hand the direction issued in the contempt petition regarding the conduct of procession followed by public meeting is in the nature of an interlocutory order and does not violate the rights of the petitioners forever.

  1. I am advised to submit that in such a scenario as per the Judgment of the Supreme Court reported in Midnapore People Co-Operative Bank Limited and others VS Chunilal Nanda and others  2006 (5) SCC 399 it was held that

“15. Interim orders/interlocutory orders passed during the pendency of a case, fall under one or the other of the following categories:

  • Orders which finally decide a question or issue in controversy in the main case.
  • Orders which finally decide an issue which materially and directly affects the final decision in the main case.
  • Orders which finally decide a collateral issue or question which is not the subject-matter of the main case.
  • Routine orders which are passed to facilitate the progress of the case till its culmination in the final judgment.
  • Orders which may cause some inconvenience or some prejudice to a party, but which do not finally determine the rights and obligations of the parties.
  1. The term “judgment” occurring in clause 15 of the Letters Patent will take into its fold not only the judgments as defined in Section 2(9) CPC and orders enumerated in Order 43 Rule 1 CPC, but also other orders which, though may not finally and conclusively determine the rights of parties with regard to all or any matters in controversy, may have finality in regard to some collateral matter, which will affect the vital and valuable rights and obligations of the parties. Interlocutory orders which fall under categories (i) to   (iii)  above, are, therefore, “judgments” for the

 purpose of filing appeals under the Letters Patent. On the other hand, orders falling under categories (iv) and (v) are not

“judgments” for the purpose of filing appeals provided under the Letters Patent”.

  1. I further submit that the case in hand the petitioners had themselves come forward with the representation dated 23.12.2022 to conduct procession followed by public meeting on 29.01.2023 and this LPA has been filed only to pressurize authorities concerned to grant permission as per their whims and fancies.
  2. I submit that the above contention that LPA have been filed only for the purpose of mounting pressure on the authorities to grant permission as per their wish is made clear from the representations dated

23.12.2022 which reads as follows: –

“The  subject mentioned L.P.A. came up for admission before the

Hon’ble Division Bench of His Lordships Justice R.Mahadevan and & Justice Sathya Narayana Prasad on 22.12.2022.  Arguments were advanced by the Appellants and the Division Bench issued Notice to the State Police/ Respondents returnable by 05.01.2023.

 It was also suggested by the Division Bench to the Appellants to make a request to the concerned Police officials/Respondents for granting permission to conduct the Route March followed by a Public meeting indicating a specific date.

  1. The above representations clearly establishes the intention of the petitioners is not to excise their rights provided under the constitution rather to mount pressure on the authorities to conduct the procession and thus create law and order situation in the state. I further submit that the representations date 23.12.2022 which solely given stating that LPA is pending before this Hon’ble High Court the case stands posted on 05.01.2023 only makes it clear the petitioners have approached this Hon’ble Court with unclean hands.

I submit that the earlier representations were made to conduct procession followed by the Public meeting on 02.10.2022 for the alleged purpose of 75th year of Independence, Gandhi Jayanthi, Dr.Ambedkar Jayanthi and Vijayadhasami. I humbly submit that now the procession for the above purpose is not relevant anymore and now the petitioners are asking this only to create a Law and Order situations and thereby affect the social harmony of the State. I further submit that when the petitioner’s organizations approach the concerned authorities for procession followed by the public meeting in appropriate time with proper details the same will be considered.
  2. I submit that the contention by the petitioners is that there is no Law and Order Issue after their organization procession in any State is not correct, to sight an example on 12.10.2022 Haveri Districts, Karnataka 20 people were arrested following the assault of petitioners organizations workers. There are various other incidents reported in neighbouring states were Petrol Bomb was hurdled against functionaries of petitioner’s organizations and allied political parties.
  3. I submit that the following cases have been registered owning to raids conducted by the NIA followed by banning Popular Front of India [PFI] by the Union Government and the cases cited clearly establishes the threat against the functionaries of the petitioner’s organization and the allied parties.

  1. I submit that, under the guise of celebrating the leader’s birthday and 75th year of Independence the petitioners have sought for procession followed by the public meeting. I further submit that the petitioner organization had never celebrated Gandhi Jayanthi or Dr.Ambedkar Jayanthi. In order to seek permission for procession where they carry arms like lathis and sticks they have camouflaged the same with leader’s birthday only in order to mislead this court and get permission to conduct procession.
  2. I submit that the petitioner’s organization had earlier filed a Writ Petition No.34440 to 34053 of 2016 and W.P.No. 637 to 641 of 2017 to conduct the procession and in these Writ petitions the petitioner’s organization had never mentioned about celebrating Gandhi Jayanthi or AmbedkarJayanthi etc. The petitioner has camouflaged the reasons in the present petition only to seek permission for possession.  The petitioner has come before this Court with unclean hands and wanted to get permission by misleading this Hon’ble Court.

  1. I submit that recently the similar procession was requested by President of Valparai Dravida Thotta Tholilalar Munnetra Sangam to conduct procession to address their grievances on the revised wages. They had requested for the procession starting right from Valparai to Coimbatore Collector Office which extended upto 105 Kms. The Commissioner of Police, Coimbatore and   Superintendent   of Police, Coimbatore Districts had rejected this representation stating Law and Order situation and other practical difficulties in conducting procession. A contempt was also filed before this court and the same was rejected by this Court concluding that there was no willful disobedience of the courts orders in not granting permission.
  2. I submit that this LPA has been filed against the order in the Contempt Petition where it was held there was no willful disobedience on the part of the authorities and consequently also order in the petitioner’s favorto conduct procession followed by the Public meeting on 06.11.2022 which was cancelled for the reasons best known by the Petitioners organizations.
  3. I submit that as alleged by the petitioners if any right has been violated or inconvenience has been caused the same is not final or prejudicial to the rights of the petitioners the same cannot be challenged by way of filing an LPA.
