This petition is coming on this day after advancing the hearing from
10.10.2025 to this day, before this court for hearing in the presence of M/s.Baaliji, S.M.,Nandinie Devhan, John Paul and K.Karthi, the Counsel for the petitioner and of the Senior Special Public Prosecutor for respondent police and upon hearing both sides, this Court delivered the following,
ORDER
1. The petitioner / A3, who was arrested on 06.08.2024 for the offencespunishable under Section 191(2), 191(3), 118(1), 103 and 351(3) of BNS altered to 61(2)(a) read with 103(1), 191(3), 351(3), 109, 238 read with 190, 49 of BNS and u/s 4(b) read with 5, 6 of the Explosive Substances Act, 1908 and Sec.3 read with 25(1B)(a) of the Arms Act, 1959 in Crime No.293/2024 on the file of the respondent police, seeks bail.
2. The present application has been filed on 06.10.2025 and was taken up forhearing on 07.10.2025. The petitioner was heard on that day. It was urged by the learned counsel for the petitioner that the health condition of the 1st accused, who is none other than the father of the petitioner herein got deteriorated and therefore, the learned counsel for the petitioner prays for an interim bail for the petitioner to attend his father and to take necessary steps to get treatment at appropriate hospital. In this connection, a Medical Report was called for from the Stanley Hospital and the Stanley Hospital has also given the Medical Report. The petition was adjourned to 08.10.2025 for hearing the Special Public Prosecutor. On 08.10.2025, the learned Special Public Prosecutor has submitted that the Hon’ble High Court, Madras in Crl.O.P.No.18671 of 2025 has quashed the charge sheet filed by the respondent police and directed the respondent police to handover the records to C.B.I. for further investigation. Aggrieved by the said order, the State is intended to prefer appeal by way of Special Leave before the Hon’ble High Apex Court. The learned Senior Special Public Prosecutor has submitted that the S.L.P. filed by the State is numberred as S.L.P. (Criminal) No.15897/2025 and the same is likely to be listed on 10.10.2025. Therefore, the present petition was adjourned to 10.10.2025. In the meantime, today, the learned counsel for the petitioner has come with an application seeking for advancing the hearing from 10.10.2025 to 09.10.2025 on the ground that the father of the petitioner herein was declared brain-dead in the morning and therefore, the bail application to be taken up today.
3. Notice was issued to the learned Senior Special Public Prosecutor and thelearned Senior Special Public Prosecutor has no objection to advance the hearing of this petition.
4. Both side heard. The daughter of the 1st accused appeared before thiscourt and informed that her father was declared brain-dead by the Doctors of the Stanley Hospital and obtained signatures from the attender. Further, on instruction, the learned Senior Special Public Prosecutor has submitted that the Doctors have not declared brain dead of the father of the petitioner, but, they are taking intensive steps to medically manage the health of the father of the petitioner. Considering the peculiar circumstances, this court is inclined to grant bail to the petitioner herein so as to attend his father and to learn the health condition of this father and also to take necessary steps to treat him better.

Accordingly, interim bail is granted until 13.10.2025 and the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/(Rupees ten thousand only) with two sureties, among them, one surety shall be a blood relative of the petitioner, each for a likesum to the satisfaction of this court and on further condition that
(a) after his release on bail, the petitioner shall not contact any other persons,except his father and the Doctors, who are treating his father.
(b) that the petitioner shall surrender before this court on 13.10.2025 at
05.30 p.m.
