ANAND VENKATESH  W.P.No.22844 of 2017 and W.M.P.No.25472 of 2017    3.In the considered view of this Court, when the Government has fixed a rate which is revised from time to time, the theatre owners cannot fleece the movie goers by collecting excess amount from them. Hence, whenever any such practise is followed by the theatres particularly, after the release of a new film, the Committee constituted by the Government shall take steps to initiate action against the concerned theatre owner and direct refund of excess amount collected. They shall also act upon any complaints that is received in this regard.  4.This writ petition is disposed of with the above direction. No Costs.  Consequently, connected miscellaneous petition is closed

In view thereof, I am not able to agree with the contention of the learned Counsel for the petitioner/accused and especially, when both the Courts below, upon appraisal of the evidence, have come to the finding that the petitioner/accused has not rebutted the presumption to the level of preponderance of probability and convicted the petitioner/accused.  The same cannot be upturned in the Revision Case unless the findings are perverse or wholly unsustainable.  Even the sentence imposed is only three months imprisonment and the cheque amount is ordered to be paid as compensation.               10. The judgment of this Court in Vikas Rambal’s case [cited supra] is contrary to the judgment of the Hon’ble Supreme Court in Cheminova’s case [cited supra].  Therefore, this Court is of the view that the impugned complaint as against the second accused is liable to be quashed.  It is needless to say that if any evidence is adduced during the course of the trial regarding the involvement of any officers of the Company, it is open to the Court concerned to summon such persons as accused in terms of Section 358 of BNSS (Section 319 of Cr.P.C.).  7.
