Senior Advocate Rachna Srivastava, for the petitioner, submitted before a bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi that the collegium composition was wrong, as Justice Banu was then a judge of the High Court. “The composition of the collegium itself was…she continued to be a judge, she had not joined the transferee High Court,” she submitted. “We can only assure you that the Chief Justice of India and the collegium judges are strong enough to take anything…thank you for advising us on that..” CJI Kant said.

The Madras High Court’s Full Bench has ruled that there’s a clear difference between ‘resignation’ and ‘voluntary retirement’, following a Supreme Court judgment. Resignation can’t be treated as voluntary retirement, and a previous judgment (D.Vijayarangan Vs. Secretary Sales Tax Appellate Tribunal and Others) is now considered incorrect. Instead, the views in A.I.Angel Illangovan Vs. The Government of Tamil Nadu are upheld. 😊

Mhc Full bench/ There is a valid distinction between ‘resignation’ and ‘voluntary retirement’ as held by the Three Judge Bench of the Hon’ble Supreme Court inSenior Divisional Manager LIC and Ors vs Shree Lal Meena[10]. Therefore, resignation from service cannot be treated as voluntary retirement. The principle settled in D.Vijayarangan Vs. Secretary Sales Tax Appellate Tribunal and Others (supra) is held to be bad in law. Therefore, the views of the division Bench of this Court in A.I.Angel Illangovan Vs.   The Government of Tamil Nadu (supra), is hereby upheld.
