In fine, I conclude with the words of the Hon’ble Supreme Court in Yogendra Pratap Singh Case, ‘no complaint can be maintained against the drawer of the cheque before the expiry of 15 days from the date of receipt of notice because the drawer/accused cannot be said to have committed any offence until then. The complaint under Section 138 of Negotiable Instruments Act filed before the expiry of 15 days of service of notice could not be treated as a complaint in the eye of the law and criminal proceedings initiated on such complaint are liable to be quashed.’ In the result, these Criminal Original Petitions are Allowed. This Court places on record its appreciation to the efforts taken by the 3rd Respondent to come out with a Directory of Manufacturers and Suppliers of Eco-alternative Materials for Single Use Plastics in Tamilnadu. A perusal of the said Directory not only shows various ecofriendly alternative materials in lieu of Single Use Plastics, but also gives details of the Manufacturers/Retailers in each District of TamilNadu. We are also also happy to note that this Directory is a first of its kind in the entire country and persons who have conceptualized the above, deserve accolades. This Directory would not only help the Retailers, but would also help the domestic purchasers, since we are informed the Directory is available online. :
