ORDER
The petitioner is a member of the Madras Advocates Cooperative Society Limited. He is aggrieved by the fact that no elections have been conducted by the Society for several years.
2.Earlier he had moved this Court by way of a writ petition in W.P.No.12560 of 2018. That writ too pertained to the affairs of the aforesaid society. The First Bench of this Court, disposed of the said writ petition by constituting a committee. The order appointed the following persons as members of the committee:-
(i)Mr.S.V.Jayaraman, Senior Counsel;
(ii)Mr.G.Mohanakrishnan, the President of Madras High Court
Advocates’ Association;
(iii)Mr.V.R.Kamalanathan, the Secretary of the Madras Bar Association;
(iv)Mr.T.V.Krishnakumar, the President of the Law Association and
(v)Mrs.V.Nalini, the President of Women Lawyers Association.
3.The committee was to examine the members / voters of the Society and thereafter delete the deceased members and include the names of the members who had been excluded. Once this process was completed, the Committee was directed to hand over its recommendations to the District Election Officer to update the members list. A time period was also fixed by the Division Bench to complete the exercise.
4.The petitioner states that the Committee has undertaken the exercise and has successfully completed the same.
5.While Mr.G.Mohana Krishnan claims that the list was handed over to the Special Officer, Mrs.Geetha Thamarai Selvan, Special Government Pleader representing respondents 1, 4 & 5 states that the said list had not been handed over. If this controversy is to be gone into, then the purpose for which the Division Bench passed the order will not be achieved. More than 7 years have gone by and still the proceeding has not moved an inch. Hence, I am inclined to pass the following direction:-
(i)Mr.G.Mohana Krishnan shall hand over the list finalized
by the Committee duly signed by himself, Mr.V.R.Kamalanathan, Mr.T.V.Krishnakumar and
Mrs.V.Nalini, by 25.09.2025;
(ii)It is informed across the Bar that Mr.S.V.Jayaraman, Senior Counsel is no more. Hence, the concluded list brought about by the Committee will have the signatures of all the other members other than Mr.S.Jayaraman.
(iii)The Special Officer shall receive the list and acknowledge the same;
(iv)The verification process as directed by the Division
Bench of this Court shall be completed by 25.10.2025;
(v)Mr.K.V.Sundararajan shall submit an election schedule. The schedule must give the time lines so that the elections to the Society are concluded by 27.11.2025.
6.Post this case on 27.10.2025.
