ORDER
(Order of the Court was made by M.S.Ramesh,J.)
In continuation of our earlier order dated 25.09.2025, paragraph 9 of the said order shall stand
modified as follows:-
“9.Since the proposed auction requires to be conducted and completed without any hindrance or other disturbances, and by taking into account that these properties pertain to the interest of about 6,50,000 members, we are inclined to pass the following specific order:
“All the Principal District Judges / District Judges and the Chief Judge, Puducherry, shall forthwith communicate to the Civil Courts under their jurisdiction to refrain from entertaining any Civil Suits by any person against the properties belonging to Kalaimagal Sabha, morefully
described under the schedule, unless leave of this Court is obtained.”
2.The Registrar (Judicial) shall circulate this portion of the amended order to all the Principal District Judges, including the Chief Judge, Puducherry, calling upon them to read this order as a part and parcel of the earlier order circulated them.
3.The learned Advocate General has filed a status report dated 10.10.2025, including the Standard Operating Procedure (SOP) for conducting the e-auction. As per the SOP, it is proposed to conduct the e-auction in three phases, namely (A) Valuation of the properties,
(B) Categorization of the properties and (C) Auction of the properties.
4.The SOP also proposes for formation of a committee consisting of (i) District Revenue Officer of the concerned District, (ii) Two professional valuers of the Institution of Valuers and (iii) District registrar (Administration) of the concerned registration district. The Special
Officer shall forthwith commence Phase A and Phase B, namely Valuation and Categorization of the properties.
5.The learned Advocate General has also produced a copy of the list of cases pending before the Principal Bench, as well as the Madurai Bench of Madras High Court, wherein the properties of Kalaimagal Sabha are the subject matters.
6.Mr.A.Selvendran, learned Special Government Pleader, appearing for the District
Collectors, has produced the reports of 11 Districts, namely Chennai, Krishnagiri,
Nagapattinam, Dharmapuri, Thoothukudi, Coimbatore, Tiruppattur, Pudukottai, Sivagangai, Cuddalore and Mayiladuthurai.
7.The learned Special Government Pleader shall ensure that the remaining 8 reports from the District Collectors are positively filed in the next date of hearing.
8.Mr.Ravee Kumar, learned Government Pleader (Pondicherry), who has been served with the details of the properties by the Special Officer on 06.10.2025, seeks for one week time.
9.Post the matter on 17.10.2025.
