CHENNAI: The Madras high court has restrained B Firdous Ahmed of Amburfrom using the trademark and symbols of Ambur Star Biriyani, saying there was enough material to show the trademark had been infringed.

Justice G Jayachandran before whom a civil suit by M Anees Ahmed, proprietor of M/s Ambur Star Briyani, came up for hearing on Friday, said: “There is prima facie material to indicate that the trademark is being infringed by the defendants (Firdous Ahmed) who deceive the common public and pass the products as those of the plaintiff (Anees Ahmed). Hence, interim injunction restraining the defendants from using the registered trademark ‘Ambur Star Briyani’ is ordered till January 30, 2020.”

Stating that the photographs of the defendants, wherein the name ‘Star’ is identical and the colour and design are predominant beneath the word ‘Ambur Briyani’ is shown, the judge recorded that though notices had been delivered to the defendant, there was no representation. Postal covers were returned with an endorsement as either ‘door closed’ or ‘left’.
