ORDER:
In the Government Orders 4th , 5th and 6th read above, orders were issued for appointment of Law Officers in various Subordinate Courts in Chennai District, on tenure basis for a period of three years.
2. Subsequently, in the Government letter 7th read above, the Government have addressed the District Collectors to send a panel of Advocates with their Applications containing Bio-data along with the reports of the Principal District Judge and the Superintendent of Police of District concerned for appointment as Law Officers on tenure basis for Subordinate Courts in the District, as per the provisions contained in Section 24 of Criminal Procedure Code, 1973 and the Standing Order issued in Government Order 1 st read above for appointment of Law Officers in various subordinate courts across the State.
3. Pursuant to this, the District Collector, Chennai in her letter 8th read above has sent proposal to Government wherein she has stated that notification was published inviting applications from eligible Advocates for appointment of Law Officers for Subordinate Courts in Chennai District. She has forwarded the panel of Advocates with her specific remarks/recommendation in the prescribed format along with original applications (in duplicate), and the reports/remarks of the Hon’ble Principal Judge, City Civil Court, Chennai and the Superintendents of Police, Kancheepuram, Chengalpattu, Thanjavur, Pudukottai and Tiruvalllur and the Commissioners of Police, Greater Chennai Police, Madurai City and Coimbatore City.
4. The Government, after careful examination of the proposal of the District Collector, Chennai, terminate the services of Law Officers appointed on tenure basis in the Government Orders 4th , 5th and 6th read above with immediate effect. Accordingly, the Government hereby appoint the following Law Officers on tenure basis for a period of three years as detailed below. The Government also relax the Government order 1 st read above in favour of Thiru.A.Govindarajan (Sl.No.3) and Thiru.D.Magarajan (Sl.No.14), Advocates, mentioned in the table below with regard to the age of the Advocates. .

5. The following are the terms and conditions for the appointment of the above Law Officers:-
i) The Law Officer shall hold office for a period of three years from the date of taking charge of his / her appointment.
ii) The appointment shall be terminated by the Government at any time before the expiry of the term of three years by giving one month’s notice in writing or by giving one month’s retainer fee in lieu of one month notice.
iii) The Law Officer may resign his / her post by giving similar notice to the Government.
iv) The above Law Officers are not entitled to use the Tri-colour State Emblem in any form, including in their letter head.
v) The services of the Law Officer will terminate automatically on his / her attaining the age of 60 years.
vi) Regarding legal opinion on official matters, the Public Prosecutor and the Government Pleader are alone competent to offer his / her opinion on the clarification raised from the District Government authorities.
vii) Any deviation of the conditions stipulated above will lead to termination of the Law Officer without prior notice.
6. The Collector of Chennai District is directed to report the date on which the Law Officers assume charge of office, to the Government.
7. The District Collector, Chennai is also directed to settle the fee claim submitted by the Law Officers subject to eligibility.

ORDER:
The services of the existing Law Officer appointed in the Government Order 4th read above in the District and Sessions Court, Chennai District under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989 (Central Act 33 of 1989) is terminated with immediate effect.
2. The Government hereby appoint Thiru.M.Sudhakar,
S/o. R. Madurai Muthu, No.33/12, Kutty Street, Seven Wells, Chennai District as Special Public Prosecutor for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), District and Sessions Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Chennai on temporary basis, pending drawal of panel of eminent senior advocates in accordance with rule 4(1) of Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Rules, 2016 as well as in compliance with the orders of the Madurai Bench of Madras High court in W.P. (MD) No.8172 of 2008, dated 25.02.2020.

3. The Law Officer mentioned in paragraph 2 above is informed that his appointment in the District and Sessions Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 in Chennai District is purely temporary and that his service are liable to be terminated at any time without prior notice. He is eligible to claim fees as per orders in force.
4. The Collector of Chennai District is directed to report the date on which the Law Officer assumes charge of office, to the Government.
5. The District Collector, Chennai is also directed to settle the fee claim submitted by the Law Officer subject to eligibility.
