*The Hon’ble Justices R. Mahadeven and J. Sathya Narayana Prasad* by Order dated 20.10.2022, in W.P.(MD) No. 22288 of 2022, has directed the District Collector, Tirunelveli District to conduct a thorough enquiry with regard to the allegation of demand of illegal gratification and threatening made by the Village President and her family members against a private business concern in the Writ Petition filed by the President to close down the Private Business concern and further directed the District Collector to suspend the President if the allegation is proved against her and to remove her from the post of President thereafter by due process of law and also to institute criminal action against her, her husband, her sons and any person concerned in the offence. It is observed as follows:-

1) The 8th Respondent concern has applied for licence for the manufacture of nitrous oxide gas and it has already obtained necessary air and water consent from the Tamil Nadu Pollution Control Board. While this being the position, the President of the Panchayat with her husband, demanded illegal gratification from the business concern and when it was refused, her sons and her men went inside the business premises and made threats to the staff of the 8th Respondent. The entire incident her been video graphed by the 8th Respondent. The 8th Respondent did not meet the illegal demands of the Petitioner. However, the President/the Petitioner has filed the Writ Petition to take action against the 8th Respondent to close the same on the ground that its manufacturing activities cause air and water pollution and it is running without valid licence.

2) The Hon’ble Bench has also directed the District Collector, Tirunelveli, to file the outcome of the enquiry and the consequential action taken report before the Court on 01.12.2022.
