COMMON ORDER
(Order of the Court was made by Dr.Anita Sumanth J.)
An affidavit has been filed by the Special Officer deferring the auction under Notification dated 14.01.2026. Reasons as per paragraph 5 thereof, read as follows:
‘5. The Hon’ble Commission has directed the Special Officer to defer all further process of public sale of properties, for the following reasons:
a. The commission found that in Bilichi, Coimbatore District properties of Kalaimaghal Sabha in two survey numbers for which revenue records exclusively stands in the name of Kalaimagal Sabha and without any encroachments were only brought for auction. However there were other properties in nine survey numbers which has minor encroachments and were not brought for auction. Therefore, the Hon’ble Commission suggested to bring the entire eleven survey numbers together for auction to realise maximum prices.
b. Demarcations and sub-divisions are required in respect of some of the properties.
c. The commission also requested the Special Officer to ensure a digital survey of every lot and to plant sufficient number of stones with specifications to precisely demarcate the properties that are brought for sale.
d. During the inspection, few temporarystructures are found in some properties brought for auction. The Special Officer was given necessary instructions for removal of temporary structures at the costs of Sabha.’
2.This is recorded.
3.Public shall be informed of the withdrawal by way of a fresh advertisement.
4.Status report has been received on behalf of the Hon’ble Commission. Various suggestions have been made in regard to the status of the properties of the Sabha under lots 1 to 7 of Notification dated 14.01.2026. The Sabha requests a period of four (4) weeks to take note of the suggestions and do the needful, as far as practicable.
5.The authorities are permitted to take necessary action to remove the encroachments in the lots and may approach the jurisdictional Station House Officer (S.H.O.) along with concerned revenue officials, and accompanied by a copy of this order, for assistance, if necessary.
6.To receive a joint report from the Special Officer and the Commission, list on 04.03.2026.
