[5/15, 10:54] K. Chandru Former Judge Of Highcourt: Quo warranti is a prerogative writ which existed since the day of establishment of the chartered high courts in india inherited from English courts.Thoughvit is also a type of a PIL it is an exception. It only relates to a person holding public office and can be filed by any person who rate person and need not be one claiming that post
For information of consel even before the case claimed to have been the first “PIL” no of public interest case were filed ,,numbered and ordered by this court. The law college professors case is not a PIL but one of quo warranto writ which power was available since 1862.!My firm m/s Row &Reddy has filed quo warranto writs against appointment of high court judges:-(1).justice Ramachandra Iyerage .justice Alagirisami(No bar experience, straight from secretariat)(3)justice Krishnaswamy Reddi(not having high court experience).
All these case were in the sixties.Let Mr.Rupert stand corrected!
