ASHA O.P.No.34 of 2020 -+As a post script, I would like to add that by resorting to different and complicated arbitral procedures with different parties and that too with reference to the same project, the petitioner is complicating the dispute resolution process by compelling parties to resort to separate procedures right from the stage of constituting the Arbitral Tribunal. In the process there would occur an inordinate delay in setting in motion the Arbitral proceedings before the Tribunal and consequently rendering the very object of the Act aimed at providing speedy remedy, otiose. Justices Sathyanarayanan and Rajamanickam, the CBI team which is probing the case submitted its second interim report. In response to the plea of Dr Madhikaran of Madurai, which sought that further examination was necessary in the case, the Court has added him as the counter-petitioner in the case.
