Chennai: Madras high court has directed the state school education department to pass appropriate orders within 12 weeks on implementing the recommendations made by the director of private schools on granting permanent recognition to private schools and upgrading primary schools into middle schools for proper implementation of the RTE Act.
Justice G K Ilanthiraiyan passed the order on Thursday, on a plea moved by the all-India private educational institutions association to direct the education secretary to consider the recommendations made by the director of private schools in March 2025 regarding granting permanent recognition to private schools.
In a separate petition, they requested the court to direct the state to ensure the full implementation of the Right to Education (RTE) Act by upgrading primary schools into middle schools, in line with the recommendations made by the director of private schools.
When the pleas came up for hearing on Thursday, senior counsel K M Vijayan, representing the association, argued that while a case challenging provisions for granting only temporary recognition to private schools is still pending, the director of private schools has already recommended granting permanent recognition.
He further noted that under the RTE Act, 25% of seats are reserved for underprivileged children. However, after completing class 5, such students are unable to secure admission in other schools. To address this issue, the director recommended upgrading primary schools into middle schools. Therefore, the court should direct the education secretary to pass orders on these recommendations, he added.
Representing the school education department, additional advocate-general J Ravindran submitted that the recommendations made by the director were subject to several conditions. Only after verifying whether each school fulfils those conditions can an order be passed.
Recording the submissions, the judge directed the education secretary to consider the director's recommendations on granting permanent recognition to private schools and upgrading them, and to issue appropriate orders within 12 weeks.
